Durable Power of Attorney in Manatee County, Florida

Quick answer

A durable power of attorney in Manatee County is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, use the Manatee County Clerk of the Circuit Court and Comptroller, not a city hall and not the court portal.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in Manatee County, or who may use the document with property here.

The phrase people type, durable power of attorney manatee county, is this page. So is manatee county durable power of attorney. A durable power of attorney manatee county is the same financial document. The page is the county. There is no city in the title, and there is no second city page. Bradenton is not the title of this page.

One Clerk records for the whole county: the Manatee County Clerk of the Circuit Court and Comptroller. The recording page says the Clerk serves as Official Recorder. The About page also names County Recorder as one of the office's functions. There is no city recorder.

Bradenton is a section because the recording FAQ says documents can be brought to the Recording department at 1115 Manatee Avenue West, and the recording contact places that street in Bradenton. That is one recording counter. It is not its own page.

Palmetto, Anna Maria, Holmes Beach, Bradenton Beach, Lakewood Ranch, Parrish, Ellenton, Myakka, and Longboat Key are not sections. No recording counter in those places was published on the pages checked. The rest of Manatee County uses this same Clerk. No separate municipal recorder was published.

Who this is not for

This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health care documents.

It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.

It is not a lawyer page. ClickDocs does not tell you to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.

Sarasota County, Hillsborough County, and Pinellas County each use a different clerk.

How it works on ClickDocs

You can finish a Florida financial DPOA without a law-firm maze. The signing rules and any recording choice stay yours.

  1. Answer the ClickDocs questions for a Florida financial durable power of attorney.
  2. Preview the draft before checkout.
  3. After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
  4. Record with the Manatee County Clerk of the Circuit Court and Comptroller only if you need it in Official Records. Recording is optional for validity.

The document ClickDocs prepares is the financial form. It is not a statutory form.

Florida requirements

These are statewide Chapter 709 rules. Manatee County does not add its own execution statute on top of them. The pages checked do not publish a witness list for powers of attorney. This page does not add one.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment, as § 709.2105 provides. Do not shorten this to "signed and notarized," and do not turn it into a Manatee County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-03.

Some authority, including gifts, must be separately signed or initialed under § 709.2202. Whether a title company wants the document recorded is an attorney question. The recording page quotes section 28.222, and that quotation includes "powers of attorney relating to any of the instruments." That quotation is not a duty to record every Chapter 709 financial power of attorney, and it is not a refusal. It does not mean an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Manatee County page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.

Recording in Manatee County

Recording is optional for validity. On 2026-10-03 the recording page said one of the Clerk's primary responsibilities is to serve as Official Recorder of documents as defined by the state statutes. The only "powers of attorney" words on that page are inside a quotation of Florida Statutes section 28.222. That quotation's property-instrument clause includes "and powers of attorney relating to any of the instruments." This page does not lift "shall file" from that quotation onto every Chapter 709 financial power of attorney, and it does not paste the rest of the instrument list. There is no separate sentence on that page that names a Chapter 709 durable power of attorney. The quotation is not a finding that this document must be recorded, and it is not a finding that the Clerk will refuse one.

An indexing manual linked from the recording page lists a document type, POWER OF ATTORNEY (POA). The definition there is an index definition: a document filed by a person, a principal, appointing another person as agent. "Document filed" in that definition is not a duty to record every financial power of attorney, and it is not a ban. That index label is not this ClickDocs form. The manual's name-format examples are not recording counters.

Angelina M. Colonneso is the name on the About page, as the current Clerk of the Court. The footer on the pages checked prints Angelina "Angel" Colonneso, Esq., Clerk of the Circuit Court and Comptroller. The custodian line prints Manatee County Clerk of the Circuit Court & Comptroller. The official pages do not agree on one string, and this page does not pick one and delete the others. Those names are the names on the pages, not a claim about who is at the counter.

Ronda Powers is the Recording supervisor on the recording contact block. She is not a second recorder, and that line is not a claim about who is at the counter.

There is no second recorder website, and there is no city recorder. Do not use a city hall to record a financial power of attorney. No second recording counter was published on the pages checked.

Primary recording page (checked 2026-10-03): Manatee Clerk, Recording.

The recording phone on the contact block and the department list is 941-741-4045. Do not send a recording question to Public Access, 941-741-4040. The main line, (941) 749-1800, is the assistance line. It is not a replacement for the recording desk. The recording block also prints a fax number, 941-741-4089. Do not fax a power of attorney to that number.

Department list (checked 2026-10-03): Departments. About the Clerk (checked 2026-10-03): About.

The address block on the recording pages says business hours are Monday through Friday, 8:30 a.m. to 4:30 p.m. It does not print a time zone. The recording contact block does not print a separate counter schedule. The recording pages checked do not print a holiday list. This page does not turn those hours into a promise that a power of attorney can be recorded at every minute of that window.

The recording contact does not print a suite, a room, or a floor.

Recording FAQ (checked 2026-10-03): Recording FAQ. Indexing guidelines (checked 2026-10-03): Indexing guidelines.

The FAQ does not use the words "power of attorney." It says the Clerk's office is unable to provide legal forms or assist in filling out legal forms, in an answer about changing a deed. A declaration of domicile is not this document. A Notice of Commencement is not this document. The FAQ's notary line for those two is not the signing rule for this financial power of attorney. A will, in that FAQ, goes to Probate, not to Recording. A deed, a lien, and a military discharge are not this document.

The FAQ mentions the Courthouse for a plat copy at Public Access. That is a copy counter, not a second place to record.

Bradenton

Bradenton is a section because the FAQ says original documents can be brought to the Recording department at 1115 Manatee Avenue West, and the recording contact places that street in Bradenton. It is the same Clerk, not a city recorder, and not its own page. Bradenton is not the title of this page.

The FAQ in-person sentence prints the street and does not print a city or a ZIP: 1115 Manatee Avenue West. This page does not add a city to that sentence.

The recording contact prints the physical address, and labels it for overnight mail: Attn: Recording, 1115 Manatee Avenue West, Bradenton, FL 34205. The address block repeats 1115 Manatee Avenue West, Bradenton, FL 34205 as the physical and overnight mail address.

The FAQ overnight line prints 1115 Manatee Avenue W, Bradenton FL 34205, with no comma before FL. The custodian line prints 1115 Manatee Avenue West, Bradenton, Florida 34205. The number 1115 matches. The official pages do not agree on Avenue West versus Avenue W, or on FL versus Florida, or on the comma, and this page does not pick. They are not three buildings, and they are not two courthouses.

The About page says the office is located in Manatee County's Historic Courthouse, and the next paragraph says the Historical Courthouse is the physical home of the office. That article does not repeat the street number. Historic and Historical are two spellings of one building. This page does not pick a spelling.

Mail is not that street. Regular mail on the recording contact is Attn: Recording, P.O. Box 25400, Bradenton, FL 34206. That block does not print "Manatee County Clerk of Court." The FAQ regular-mail line does: Manatee County Clerk of Court, Attn: Recording, PO Box 25400, Bradenton FL 34206. The ZIP 34206 matches. This page does not drop the office name from the FAQ line, and it does not add that office name to the contact block. The box and the street are not two recorders. Overnight is the street. Regular mail is the box.

The FAQ mail line says to include the appropriate fees and a self-addressed envelope. That envelope line is for mail. A check on that path is payable to Clerk of Circuit Court. That payee line is not the title of the office. The pages checked do not name a cash path or a card rule.

In person, mail, and a third-party vendor

In person, the FAQ says you can bring original documents to the Recording department at 1115 Manatee Avenue West, and that originals are returned the same day. That sentence does not name a power of attorney, and it does not print a city or a ZIP. The same-day line is about originals brought in person, for documents in general. It is not a promise that a financial power of attorney is recorded the same day, and it is not the mail rule.

By mail, regular mail is the box, P.O. Box 25400, Bradenton, FL 34206, as the recording contact prints it, and the FAQ line adds Manatee County Clerk of Court and a self-addressed envelope. Overnight is the 1115 street. The recording introduction says the department returns the original by mail. The FAQ says mailed documents are recorded the day they are received, and to allow 3 to 5 business days from the day they are recorded for the return. Those mail sentences are not the in-person rule. This page does not collapse the return lines into one promise.

e-Recording is through a third-party vendor. The e-recording page says it is submitting and recording documents online through a third-party vendor, and that a person needs a computer with a high-speed internet connection and a scanner. It says almost every document that can be recorded in person or by mail can also be recorded electronically. "Almost every document" is not a promise that a financial power of attorney can be e-recorded. The page does not describe a public account on the Clerk's own site.

The FAQ says you subscribe with an approved vendor, you retain the original, and the recorded image is sent back as soon as the document is recorded. "As soon as the document is recorded" is not a promise that a financial power of attorney is recorded the same day.

Vendors named on that page: CSC, EPN, File & Go, HopDox, and Simplifile. Phones and vendor prices stay on that page. They are not copied here. Being listed is not a promise that a vendor will take a financial power of attorney.

The cannot-e-record list is Certificates of Compliance or Report of Sale, Military Discharge, Notice of Homestead, Notice of Contest of Lien, Plats, and Transfer of Lien to Security. Power of attorney is not on that list. This page does not add it. That silence is not a promise that a financial power of attorney can be e-recorded, and it is not a statement that the office cannot record one. e-Recording.

Deeds, notices of commencement, declarations of domicile, liens, military discharges, wills, plats, birth and death certificates, fictitious names, and apostilles appear as other answers. They are not this document.

Recording charges

See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.

The fee page has a Recording Fees heading. No figure from that page is copied here. A deed and mortgage calculator on the Clerk site is not a power-of-attorney price. This page does not copy a total from it. A vendor may add its own price. This page does not copy one. Recording fees.

Not the court portal

Recording a financial power of attorney is the Clerk recording path above. The recording page, the recording FAQ, the fee page, and the e-recording page do not send recording to the Florida Courts E-Filing Portal. Online Services links that portal under Courts E-Filing. That page is about online payments, court-case search, and marriage-license applications. It is not this step. Online Services.

The court portal is myflcourtaccess.com. It is not the way to record this document. myflcourtaccess.com.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.

It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.

This page is the financial document under Chapter 709. It does not cover health care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-03.

Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The section 28.222 quotation is not a duty to record every Chapter 709 financial power of attorney, and it is not a refusal. The index label POWER OF ATTORNEY (POA) is not a duty, not a ban, and not this form.
