Durable Power of Attorney in St. Petersburg (Pinellas County), Florida

Quick answer

A durable power of attorney in St. Petersburg is a Florida Chapter 709 financial document for money and property in Pinellas County. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, the main counter is the Pinellas Clerk of the Circuit Court and Comptroller in Clearwater, not a city hall and not the court portal.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in St. Petersburg or Pinellas County, or who may use the document with property here.

St. Petersburg is the lead city. One office records for the whole county: the Clerk of the Circuit Court and Comptroller. There is no city recorder. The recording page headlines the main counter in Clearwater. That counter is the same Clerk, and it serves people who live in St. Petersburg.

Largo, Dunedin, Pinellas Park, Seminole, and Tarpon Springs use that same office. They are not separate recording offices.

Who this is not for

This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health-care documents.

It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.

It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.

It is not the recording page for a different county. Tampa and Hillsborough County, Orlando and Orange County, Fort Lauderdale and Broward County, Miami and Miami-Dade County, Palm Beach County, and Pasco County each use a different recorder.

How it works on ClickDocs

You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.

  1. Answer the ClickDocs questions for a Florida financial durable power of attorney.
  2. Preview the draft before checkout.
  3. After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
  4. Record with the Pinellas Clerk of the Circuit Court and Comptroller only if you need it in Official Records. Recording is optional for validity.

The document ClickDocs prepares is the financial form. It is not a statutory form.

Florida requirements

These are statewide Chapter 709 rules. Pinellas County does not add its own execution statute on top of them.

A Florida power of attorney is not durable without the § 709.2104 words, or similar words of intent. Source: Florida Senate, § 709.2104 (2026), checked 2026-10-02.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into a Pinellas County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.

Except as § 709.2108 provides, the power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.

Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Source: Florida Senate, § 709.2202 (2026), checked 2026-10-02.

Whether a title company wants the document recorded is an attorney question. The recording how-to does not name a power of attorney. It says the Clerk records only instruments expressly entitled to recordation under Florida Statutes, and it links recordable-instrument lists. This page does not turn those links into a document list. A View Records example that includes power of attorney is not a duty to record, and it is not a statement that an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second St. Petersburg page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.

Recording in Pinellas County

Recording is optional for validity. On 2026-10-02 the Recording Services how-to did not name a power of attorney. The fee page and the calculator did not name one either. The View Records page lists power of attorney among examples of records people view, with deeds, mortgages, marriage licenses, and affidavits. That is an index example. It is not the recording how-to. Naming it there is not a duty to record, and it is not a statement that the Clerk cannot record one. Whether a title company wants it recorded needs a Florida attorney.

The county recorder is the Clerk of the Circuit Court and Comptroller. Clerk and Comptroller are one office here. The Recording Services page says that office is the County Recorder, responsible for recording recordable documents into the Official Records of Pinellas County. The Clerk Administration page lists the same duty, as Recorder of Deeds, maintaining the Official Records. There is no second recorder website, and there is no city recorder. Do not use a city hall, and do not use the court e-filing portal, to record a financial power of attorney.

Ken Burke, CPA, is the name on the Clerk Administration page, as Pinellas County Clerk of the Circuit Court and Comptroller. The recording-fee calculator prints the same name as the check payee. That is the name on those pages, not a claim about who is at the counter today.

Primary recording page (checked 2026-10-02): Pinellas Clerk, Recording Services. Locations, phones, and drop boxes: Contact Us. Clerk Administration: Clerk Administration. View Records (an index example, not the recording how-to): View Records.

Where to go

In person, the counter the recording page headlines is the Recording Services Department, 315 Court Street, Room 150, Clearwater, FL 33756. The calculator shortens that to 315 Court St, Rm. 150, Clearwater, FL 33756. Court Street and Court St are the same street. Room 150 and Rm. 150 are the same room, not a second building.

Phone: (727) 464-7000. Recording email: [email protected]. General email: [email protected]. Do not treat email as a way to record a power of attorney.

Hours for that recording counter: Monday through Friday, 8:30 a.m. to 4:30 p.m., with holidays excepted. The holiday list is on the Contact-Us page. This page does not copy it.

The St. Petersburg branch is the same Clerk, not a city recorder. Recording Services lists it as recording full service at 545 First Avenue North, St. Petersburg, FL 33701, with the same phone and the same 8:30 a.m. to 4:30 p.m. hours. Contact-Us says this branch can record and image legal documents into the Official Records. The full-service listing does not print a room. This page does not add one.

Official Records at 315 Court Street, Room 163, Clearwater, FL 33756, is the copies, search, and redaction counter. It is not the recording intake room.

A search of records already in Official Records is not the recording counter: officialrecords.mypinellasclerk.gov.

In person, mail, drop box, and vendor e-recording

In person, at Room 150 in Clearwater, or at the St. Petersburg full-service branch at 545 First Avenue North, Monday through Friday, 8:30 a.m. to 4:30 p.m., except holidays on the Contact-Us page. For a time-sensitive document, the recording page says to consider recording in person during those hours. Confirm the current counter before you go.

By mail, use the street line the calculator prints: Ken Burke, Clerk of Courts, RECORDING SERVICES, 315 Court St, Rm. 150, Clearwater, FL 33756. Make checks payable to Ken Burke, Clerk of the Circuit Court. Include a self-addressed, stamped envelope of sufficient size and with proper postage. Originals come back in that envelope. That mail line is a street address. It is not a post office box. Do not mail a financial power of attorney to a finance-division address or a court-fines drop box.

The recording page does not guarantee same-day or next-day recording for mail.

A drop box at 315 Court Street is at the South entrance parking lot. A St. Petersburg recording drop box is described as facing Mirror Lake Drive, on the north side of that courthouse, without a street number. That is a box location, not a mailing address. Do not mail a power of attorney to Mirror Lake Drive. A drop box is not the place the document is recorded. The recording page does not guarantee same-day or next-day recording for a drop box.

eRecording is through a vendor. The recording page says you use an eRecord vendor, scan the original, and submit it online to the Clerk's recording office. You cannot upload a power of attorney on the Clerk's own site. No separate consumer upload portal for a financial power of attorney was on the pages checked.

Volume vendors, as printed on 2026-10-02: eRecording Partners Network (EPN); Corporation Service Company (CSC); Hopdox; Simplifile. Specialty or lower-volume vendors, as printed: E-Recording USA; File and Go; Record-Nation. The page says specialty services are typically focused on specific document types, such as a notice of commencement and lien or claim-related documents, and that the Clerk has no direct relationship with those specialty providers. It also says the Clerk is working to list additional vendors. That specialty note is not a promise that a power of attorney can be eRecorded, and it is not a promise that every vendor will take one. Phones stay on the Clerk's page. They are not copied here. The recording page does not guarantee same-day or next-day recording for eRecording.

The recording page says you are responsible for accuracy and completeness, that the Clerk may reject a document that is not authorized to be recorded, and that a recorded document cannot be removed without a court order. It says to contact an attorney for help preparing a legal document.

A September 11, 2023 Clerk Alert from this office says that, effective January 1, 2024, the office applies an amendment to Florida Statute 695.26 to instruments by which title to real property is conveyed, assigned, encumbered, or disposed of. The alert calls for a witness name legibly printed under the signature, and a witness address on the instrument. The alert does not name a power of attorney. A Florida attorney should review it before anyone applies it to a financial power of attorney. It is not a substitute for § 709.2105, and it is not a Pinellas County execution rule. Clerk Alert, new requirements for recording documents (PDF).

A note on the recording page about Florida Statute 28.29 is about final judgments and non-final court orders. It is not this document.

Marriage licenses, passports, tax deed sales, declaration of domicile, and domestic-partnership registration are other services on the same page. They are not this document.

Recording charges

See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.

The Recording Services page says fees are set by legislative action and can change, and it points to the current fee schedule. The fee page says charges are established by statute, ordinance, and other authority. This page does not copy a figure from it. The calculator is not a power-of-attorney price. fee schedule. Calculator (not a power-of-attorney fee): recording-fee calculator.

Not the court portal

Recording a financial power of attorney is the Clerk & Comptroller Recording path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.

Find-A-Service lists court e-filing and e-recording as separate items. E-filing is not the recording step. Find-A-Service.

The Justice Center on 49th Street North is criminal court, jury, and related services. It is not the recording counter. Do not take a financial power of attorney there to record it.

Clearwater

Clearwater uses the same Clerk of the Circuit Court and Comptroller as St. Petersburg. It is not a city recorder, and it is not a city hall. The main recording counter is here: 315 Court Street, Room 150, Clearwater, FL 33756. Phone (727) 464-7000. Hours Monday through Friday, 8:30 a.m. to 4:30 p.m., except holidays on the Contact-Us page. That counter serves the whole county, including people who live in St. Petersburg.

A North County customer counter is also published in Clearwater, at the Fessler Center, Building B, 3165 McMullen Booth Road, Clearwater, FL 33761. The clerk pages do not settle what that counter does with a power of attorney. Confirm it on the current recording page before you rely on that counter. Building B is not a second address, and it is not a second recorder. Pinellas Clerk, Recording Services.

Largo, Dunedin, Pinellas Park, Seminole, and Tarpon Springs use this same Clerk. No Official Records office was published for them. Gulfport, Safety Harbor, Oldsmar, St. Pete Beach, and the beach towns use this same Clerk too. They are not separate recording offices.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.

It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.

This page is the financial document under Chapter 709. It does not cover health-care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.

Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The recording how-to does not name a power of attorney, and this page does not turn that silence, or a View Records example, into a duty to record or into a ban.
