Durable Power of Attorney in Orlando (Orange County), Florida
Quick answer
A durable power of attorney in Orlando is a Florida Chapter 709 financial document for money and property in Orange County, Florida. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, you use the Orange County Comptroller, Official Records, not the Clerk of Courts and not the court e-filing portal.
Who this is for
This page is for an adult who wants a Florida financial durable power of attorney and lives in Orlando or Orange County, Florida, or who may use the document with property here.
Orlando is the lead city. The Orange County Comptroller, Official Records, is in Orlando and serves the whole county. There is no city recorder. Winter Park is on this page because it uses that same office. Apopka, Ocoee, and Winter Garden use it too.
Who this is not for
This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health-care documents.
It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. A clause that waits for a future date or a future event is generally ineffective under § 709.2108, except as that section provides. ClickDocs does not offer a springing power of attorney.
It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.
It is not Orange County, California. This page is Orange County, Florida, only.
It is not the recording page for a different county. Kissimmee is in Osceola County and uses a different recorder. Sanford and the rest of Seminole County, the rest of Osceola County, Lake County, Brevard County, and Polk County each use a different recorder. So do Tampa and Hillsborough County, Fort Lauderdale and Broward County, and Miami and Miami-Dade County.
How it works on ClickDocs
You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.
- Answer the ClickDocs questions for a Florida financial durable power of attorney.
- Preview the draft before checkout.
- After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
- Record with the Orange County Comptroller, Official Records, only if you need it in Official Records. Recording is optional for validity.
The document ClickDocs prepares is the financial form. It is not a statutory form.
Florida requirements
These are statewide Chapter 709 rules. Orange County, Florida, does not add its own execution statute on top of them.
A Florida power of attorney is not durable without the § 709.2104 words, or similar words of intent. Source: Florida Senate, § 709.2104 (2026), checked 2026-10-02.
Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into an Orange County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.
The power of attorney is effective when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as § 709.2108 provides. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.
Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Source: Florida Senate, § 709.2202 (2026), checked 2026-10-02.
Whether a title company wants the document recorded is an attorney question. The Official Records landing page does not name a power of attorney. Naming the document type somewhere else is not a duty to record, and it is not a statement that an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Orlando page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.
Recording in Orange County, Florida
Recording is optional for validity. On 2026-10-02 the Official Records landing page did not name a power of attorney. The Recording Fees page did not either. A county newsroom directory names power of attorney inside a long list, and the Comptroller's eRecording business rules list Power of Attorney as an eligible type. Naming a type is not a duty to record, and it is not a statement that an unrecorded power of attorney is invalid. Whether a title company wants it recorded needs a Florida attorney.
The Orange County Comptroller's Official Records Department records, indexes, and archives the Official Records of Orange County, Florida. The same page says the department collects documentary stamp taxes, intangible taxes, recording fees, and other fees. The examples on that page include deeds, mortgages, satisfactions, claims of lien, final judgments and orders, notices of commencement, and declarations of domicile. Power of attorney is not in that list.
The county recorder here is the Comptroller, not the Clerk of Courts. An unrecordable-document notice from this office says that under § 28.222 the clerk of the circuit court is the recorder of instruments the law requires or authorizes to be recorded, and that in Orange County that role is the comptroller. The eRecording business rules open as the County Recorder for Orange County, under the Comptroller's office. Do not use the Clerk of Courts, and do not use the court e-filing portal, to record a financial power of attorney.
Phil Diamond, CPA, is the comptroller named on the Official Records search disclaimer, the fee documents, and that unrecordable notice. Kyle Quackenbush, Official Records Manager, signed the notice (version 08-03-2023). Those are the names on those documents, not a claim about who is at the counter today.
Primary recording page (checked 2026-10-02): Orange County Comptroller, Official Records. Directory for the same department: Official Records directory. Unrecordable-document notice (comptroller is the recorder in Orange County): unrecordable-document notice. eRecording business rules (Power of Attorney listed as an eligible type): eRecording business rules. County directory blurb (not the recording how-to): county directory. Search of records already in Official Records is not the recording counter: search Official Records.
Where to go
In person: 109 East Church Street, Suite 300, Orlando, FL 32801. The notice-of-commencement page prints the same place as 109 E. Church St., Suite 300. Suite, city, and ZIP match. "East" and "E." are the same street, not a second building. No other Official Records street was published on the pages checked 2026-10-02.
Mail: Attn. Official Records, PO Box 38, Orlando, FL 32802. A shorter line on the notice-of-commencement page, and the site footer, use that same box number and ZIP. Do not invent a street address for mail.
Make checks payable to the Orange County Comptroller. What the office accepts is on the Recording Fees page. This page does not copy a card limit or a payment example.
Phone for Official Records / Recording: 407-836-5115. The eRecording page's line for more information is 407-836-5111. The footer line for administration and general inquiry is 407-836-5690. Those are different lines, not two answers about the recording desk.
Hours: Monday through Friday, 7:30 am to 4 pm. The pages checked did not print a holiday calendar. This page does not invent a closed date.
The footer email is a contact form. It is not a way to record a power of attorney.
Do not record at the Orange County Courthouse room the FAQ uses for certain marriage-license copies: 425 N Orange Avenue, Room 150, Orlando, FL 32801, phone 407-836-6321. That is not the Official Records counter.
In person, mail, and vendor e-recording
In person, at 109 East Church Street, Suite 300, during the published hours.
By mail, to Attn. Official Records, PO Box 38, Orlando, FL 32802. The forms page checked on 2026-10-02 did not publish a recording transmittal sheet for this office. Do not add a cover sheet from another county.
eRecording is through a vendor. You scan the document and upload it with a vendor application. Originals stay with the submitter. The Comptroller is precluded from recommending vendors. The business rules list Power of Attorney as an eligible eRecording type. They do not give you a way to upload one on the Comptroller's own site. Do not treat a vendor list as a promise that a particular file will be accepted, and do not e-record a power of attorney without a vendor. Phones and vendor sites stay on the Comptroller's eRecording page. They are not copied here.
Vendors as grouped on that page on 2026-10-02, not re-ordered. Volume / lower cost: Corporation Service Company (CSC); eRecording Partners (EPN); Simplifile; Hopdox. Low volume / higher convenience cost: Record Nation; Deeds; eRecording USA.
eRecording page (checked 2026-10-02): Orange County Comptroller eRecording.
The Comptroller's Tyler portal is for a notice of commencement and a termination of a notice of commencement. Florida construction-lien law is why that page exists. It is not a path for a financial power of attorney. Links there to Orange County cities are for permitting, not for recording this document. E-file a notice of commencement.
The Comptroller's own timing answers do not agree. A general answer, a deed-by-mail answer, and the eRecording page do not use one clock. This page does not pick one, and it does not promise same-day recording. Confirm how long recording takes on the current Official Records page. Official Records. Official Records FAQs.
No drop box was published on the Official Records, FAQ, eRecording, or notice-of-commencement pages checked 2026-10-02. Do not use one.
The Official Records FAQ discusses witnesses for a deed or other transfer document. It does not name a power of attorney. Notes on the fee schedule about dates, legal descriptions, signatures, notarial acknowledgments, and preparer blocks are general recording-presentation notes. A Florida attorney should review those notes before anyone applies them to a financial power of attorney. They are not a substitute for § 709.2105, and they are not an Orange County execution rule.
The same FAQ says staff cannot give legal advice or help prepare legal forms, and it points to § 28.222 for what the office may accept for recording. That is not the Chapter 709 signing rule. The FAQ also says the customer is responsible for preparation. The Comptroller does not publish a power of attorney form. A domicile form, a notice of commencement, or a lien form from that office is not this document.
Forms the Comptroller publishes (no power of attorney form): forms and publications.
The county directory that names power of attorney also names marriage licenses and divorce records. The current Official Records FAQ says marriage licenses are no longer recorded in the Official Records, effective July 1, 2017, and it sends some marriage-license copies to the Clerk of Courts. Treat that directory paragraph as a blurb at the same Church Street address, not as the current document list and not as a duty to record.
Recording charges
See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.
The live fee page is the Comptroller's Recording Fees page. It did not name a power of attorney. The Comptroller also links schedule PDFs, and those pages do not agree with each other as a set. This page does not copy figures from the fee page or from either PDF, and it does not treat either PDF as a power-of-attorney price. Do not use a deed calculator, a mortgage calculator, or a copy charge as that price. Recording Fees.
Deed, mortgage, and related calculators are not a power-of-attorney fee: fee calculators.
Not the court portal, and not the Clerk of Courts
Recording a financial power of attorney is the Comptroller Official Records path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.
The Orange County Clerk of Courts site is court divisions, not Official Records. Do not send a power of attorney there. myorangeclerk.com.
Winter Park
Winter Park uses the same Orange County Comptroller, Official Records, as Orlando. The counter is at 109 East Church Street, Suite 300, Orlando, FL 32801. It serves the whole county. Winter Park does not have a city recorder. A Comptroller page lists the City of Winter Park as a permitting contact for a notice of commencement. That listing is not a recording office.
Apopka, Ocoee, and Winter Garden are in Orange County, Florida. They use this same Comptroller. No separate Official Records office was published for them.
The same county recorder also covers unincorporated Orange County, Maitland, Belle Isle, Oakland, Windermere, Edgewood, and Eatonville. Those are not separate recording offices.
What the document can and cannot do
It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.
It is not durable without the § 709.2104 words. A clause that waits for a future event does not make a delayed product under § 709.2108, except as that section provides.
This page is the financial document under Chapter 709. It does not cover health-care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.
Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The Official Records landing page does not name a power of attorney, and this page does not turn that silence, or an eRecording type list, into a recording rule.
