Durable Power of Attorney in Jacksonville (Duval County), Florida

Quick answer

A durable power of attorney in Jacksonville is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. Florida execution needs your signature, two witnesses, and a notary. Recording is optional. If you record it in Duval County, the Clerk Recording Department is in Jacksonville and can return originals while you wait when you bring them in person.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in Jacksonville or Duval County, or who may use the document with property recorded in Duval. Jacksonville and Duval are one recording county for this hub (consolidated city-county). The same Duval Clerk Official Records rules apply if you live in Jacksonville Beach, Neptune Beach, Atlantic Beach, or Baldwin. Those cities are named here. They do not get separate ClickDocs URLs.

Who this is not for

This page is not for someone who wants a health care surrogate or a “medical power of attorney.” That intent belongs on the Chapter 765 Learn page. See /learn/florida-health-care-surrogate. It is not for someone who wants the power of attorney to wait until a doctor finds incapacity. A new springing clause is ineffective for a post–October 1, 2011 Florida POA under § 709.2108. It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. It is not the recording page for St. Johns, Clay, or Nassau County.

How it works on ClickDocs

  1. Answer the ClickDocs questions for a Florida financial durable power of attorney.
  2. Preview the draft before checkout.
  3. After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment. ClickDocs does not notarize it on this page.
  4. Record the original with the Duval Clerk only if you need it in Official Records. Recording is optional for validity.

The document ClickDocs prepares is a financial form. It is not a statutory form.

It is generally exercisable when you sign it. A new springing clause is ineffective under § 709.2108 for instruments executed after October 1, 2011 (with limited exceptions described in the statute). Source: Florida Senate, § 709.2108 (2026), checked 2026-09-14.

Some extra authority needs your sign or initial next to that power under § 709.2202. Homestead, gifts, and capacity need a Florida attorney.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and proper Florida execution. It cannot become durable without the § 709.2104 words. A new springing clause does not create a delayed product under § 709.2108 for a new Florida POA.

ClickDocs keeps medical decisions off the financial form. Florida law can allow health care authority in a durable power of attorney if that authority is specifically granted under § 709.2201(2)(c). That is not a claim that a Florida POA cannot be medical. Seekers of a health care decision-maker should use the Chapter 765 designation of health care surrogate path: /learn/florida-health-care-surrogate.

Recording is optional for validity. Skipping recording does not make the document invalid by itself. Whether a title company wants it recorded needs a Florida attorney.

Recording in Duval County

Recording is optional for the power of attorney to be valid. Recording is a Clerk Official Records step. It often matters when real property or a title company is involved. This page does not say Duval requires every financial DPOA to be recorded.

The Clerk of the Circuit Court is the official recorder of instruments that may be recorded in Duval County. Instruments go in one series called the Official Records. Primary Clerk Recording page (checked 2026-09-14): duvalclerk.gov Recording. Official Records research (search and copies — not the recording counter how-to): Official Records and research.

Where to take it

Recording Department, Duval County Clerk of the Circuit Court, 501 West Adams Street, Jacksonville, Florida 32202. Phone: (904) 255-2000. Hours: Monday–Friday (excluding holidays), 8:00 a.m. – 5:00 p.m. Mail uses that street address with Attention: Recording Department 1054, as printed on the Clerk page.

The Official Records research desk is Room 1253, phone (904) 255-2025. That desk is for search and copies. It is not a substitute for the recording how-to. The Duval Recording page fetched 2026-09-14 does not name power of attorney in its instrument list. Silence is not a statement that a POA cannot be recorded.

In person, mail, and e-recording

When you bring original documents into the office to be recorded, the Clerk says your originals will be scanned, recorded, and returned to you while you wait. Copies cannot be recorded.

The Clerk cannot guarantee same or next-day recording for documents received by mail or through eRecording. For time-sensitive recording, consider going in person. The filer is solely responsible for timeliness. There is no Duval drop box published on the Recording page checked 2026-09-14.

All packages are required to have the Clerk’s Recording Transmittal Sheet attached and completed. Mail: originals + Recording Transmittal Cover Sheet + self-addressed stamped envelope. Payment: money order, business check, or cashier’s check payable to “Duval Clerk of the Circuit Court.” No personal checks.

The Clerk offers eRecording through third-party vendors and does not recommend or endorse a vendor. Direct submitters listed on the page include CSC, eRecording Partners Network, Hopdox, and Simplifile. This page does not claim that a consumer can e-record a power of attorney in Duval. Check the Clerk and vendor for document-type eligibility. Do not use the Florida Courts E-Filing Portal (myflcourtaccess) to record a financial power of attorney. That portal is for court case filings.

Recording charges

These are general recording charges from the Duval Clerk Recording page, checked 2026-09-14. They are not a power of attorney fee. Charges can change. Confirm on the Clerk page before you rely on a dollar total: $10.00 for the first page of a document; $8.50 for each additional page, per document; $1.00 indexing fee for each name after the fourth. Do not use the Clerk’s mortgage/deed fee calculator defaults as a power of attorney quote. Notice of Domicile fees on the same page are not POA fees. Source: duvalclerk.gov Recording.
