Durable Power of Attorney in Tampa (Hillsborough County), Florida
Quick answer
A durable power of attorney in Tampa is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, you use the Hillsborough Clerk of Court Recording Department, not the court e-filing portal.
Who this is for
This page is for an adult who wants a Florida financial durable power of attorney and lives in Tampa or Hillsborough County, or who may use the document with property here.
Tampa is the lead city. One clerk records for the whole county. Brandon is on this page because that same clerk lists a Recording counter at the Brandon Regional Service Center. Plant City, Temple Terrace, Riverview, and Town 'n' Country use that same clerk. None of them has a city recorder.
Who this is not for
This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health-care documents.
It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. A new springing clause is generally ineffective under § 709.2108. ClickDocs does not offer a springing power of attorney.
It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.
It is not the recording page for a different county. St. Petersburg, Clearwater, and the rest of Pinellas County, Lakeland and the rest of Polk County, Orlando and Orange County, Fort Lauderdale and Broward County, and Miami and Miami-Dade County each use a different recorder.
How it works on ClickDocs
You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.
- Answer the ClickDocs questions for a Florida financial durable power of attorney.
- Preview the draft before checkout.
- After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
- Record with the Hillsborough Clerk of Court Recording Department only if you need it in Official Records. Recording is optional for validity.
The document ClickDocs prepares is the financial form. It is not a statutory form.
Florida requirements
These are statewide Chapter 709 rules. Hillsborough does not add its own execution statute on top of them.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary. That is § 709.2105. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.
The power of attorney is effective when executed. A new clause that waits for a future event is generally ineffective under § 709.2108. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.
Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Whether a title company wants the document recorded is an attorney question. The recording page does not name a power of attorney, and this page does not turn that silence into a duty to record. The statewide product page and the Learn page go deeper on the financial document. They are not a second Tampa page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.
Recording in Hillsborough County
Recording is optional for validity. On 2026-10-02 the recording page did not name a power of attorney, and the fee page did not either. That silence is not a duty to record, and it is not a statement that the office cannot record one. Whether a title company wants it recorded needs a Florida attorney.
The Clerk of Court Recording Department records, indexes, and archives the documents that create the Official Records of Hillsborough County. The same office is the county recorder. It also collects documentary stamp taxes, intangible taxes, recording fees, and other fees. It is the Clerk of the Circuit Court and Comptroller. The clerk named on the clerk site is Victor D. Crist. That is the office holder, not a recording-desk person.
Court customer service is a different building. Do not use that counter, and do not use the court e-filing portal, to record a financial power of attorney.
Primary recording page (checked 2026-10-02): Hillsborough Clerk recording. Walk-in sites and hours: service options and locations. Office holder: Victor D. Crist. Search of records already in Official Records is not the recording counter: Official Records search.
Where to go
Recording is on the clerk's Recording service list: downtown Tampa, Brandon, and Plant City. Those are branches of this same clerk, not city recorders. The locations page offers Get In Line Now for Recording.
The Tampa recording building is the Pat Collier Frank Courthouse. Hours printed on that building block are 8 AM to 5 PM, Monday through Friday. Phone (813) 276-8100. The same phone is on the recording page's options table.
The clerk's own pages do not agree on one downtown Tampa street, or on one mail ZIP. This page does not pick a door and does not pick a ZIP. Use the current recording page for the street and the mail line before you go or send anything.
The recording page does not print a clock time. It points wait times to the locations page. Use the building hours on that page. The locations page says to check the holiday schedule. This page does not invent a closed date.
Email is not a way to record a power of attorney. The options table sends Email to a contact form. A deed answer on the recording page says an original can be brought in or mailed, but not by email. The address [email protected] is printed for subscription help and for redaction or removal requests. Do not use it to record. Contact form (not recording): email the clerk.
In person, mail, and vendor e-recording
In person is the only path the clerk says guarantees same-day recording. The recording page says mail and e-recording are processed in the order received, and the clerk cannot guarantee same-day or next-day recording for those. For a time-sensitive document, record in person. Confirm the current Tampa street on the recording page before you go. Brandon and Plant City are on the same Recording list.
Mail uses the recording page's mail line, with a Recording Transmittal form or a cover letter, and a self-addressed stamped envelope large enough for the return. The same page does not use one ZIP for every document type. Do not guess which line receives a power of attorney. Confirm the current mail line on the recording page.
The Recording Transmittal form is linked from the recording page. It is not a Chapter 709 form, and it is not the document on this page.
eRecord only through a third-party vendor. The clerk provides a list of vendors as a courtesy and is precluded from recommending any vendor. You use a vendor at your own risk. Power of attorney is not named. This page does not claim you can e-record a financial power of attorney. Phones and vendor sites stay on the clerk's page. They are not copied here.
Vendors as listed on the recording page on 2026-10-02, in that order: CSC Corporation Service Company; e-Doc Solutions; eRecordings Partners Network; Indecomm Global Services; RecordNation, Low Volume Vendor; Simplifile; File and Go (notices of commencement); eRecordingUSA; Hopdox; Swift-E Recording Services.
The recording page also announces a consumer e-recording portal for notices of commencement only. That is not a consumer path for a financial power of attorney.
No drop box was published on the recording page or the locations page checked 2026-10-02. Do not use one.
The recording page, which dates its note to January 1, 2024, describes a witness-name and post-office-address rule for an instrument that conveys, assigns, encumbers, or otherwise disposes of an interest in real property. Power of attorney is not in the types named there. A Florida attorney should review that note before anyone applies it to a financial power of attorney. It is not a substitute for § 709.2105, and it is not a Hillsborough execution rule.
Recording charges
See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.
The fee page has a Recording Services heading. It does not name a power of attorney. Do not use a deed calculator, a mortgage calculator, or a copy charge as a power of attorney price. The recording page links a Recording Services Fees jump. On 2026-10-02 that link stayed on the fee page. This page does not promise the jump will scroll to the table. Hillsborough fees and fines.
Not the court portal
Recording a financial power of attorney is the Clerk Recording Department path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.
Edgecomb Courthouse, 800 E. Twiggs Street, Tampa, is court customer service. Room 101 on that building block is Customer Service, Monday through Friday, 8 AM to 5 PM. Recording is not on that service list. Do not take a power of attorney there because it is the courthouse.
Brandon
Brandon uses the same Hillsborough Clerk of Court Recording Department as Tampa. The locations page lists Recording at the Brandon Regional Service Center, 311 Pauls Drive, Suite 110, Brandon, FL 33511. That building is open Monday through Friday, 8 AM to 4 PM. Phone (813) 276-8100.
Plant City is on the same Recording list, at the Plant City Courthouse, 301 North Michigan Ave, Plant City. Hours on that building block are Monday through Friday, 8 AM to 5 PM. It is still this clerk, not a city recorder.
Temple Terrace, Riverview, and Town 'n' Country are in Hillsborough. They use this same clerk. The locations page did not publish a separate recording counter for them.
Other Hillsborough places use this same clerk.
What the document can and cannot do
It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.
It is not durable without the § 709.2104 words. A new springing clause does not make a delayed product under § 709.2108.
This page is the financial document under Chapter 709. It does not cover health-care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.
Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The recording page does not name a power of attorney, and this page does not turn that into a recording rule.
