Durable Power of Attorney in West Palm Beach (Palm Beach County), Florida

Quick answer

A durable power of attorney in West Palm Beach is a Florida Chapter 709 financial document for money and property in Palm Beach County. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, you use the Palm Beach County Clerk of the Circuit Court & Comptroller, not a city hall and not the court e-filing portal.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in West Palm Beach or Palm Beach County, or who may use the document with property here.

West Palm Beach is the lead city. The main recording room is in West Palm Beach, and it serves the whole county. One office records for every city here: the Clerk of the Circuit Court & Comptroller. There is no city recorder.

Boca Raton, Delray Beach, and Boynton Beach are on this page because they use that same office. Wellington, Jupiter, Lake Worth Beach, Palm Beach Gardens, Belle Glade, and Royal Palm Beach use it too. The Town of Palm Beach does not have its own recorder.

Who this is not for

This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health-care documents.

It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. A power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as § 709.2108 provides. ClickDocs does not offer a springing power of attorney.

It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.

It is not the recording page for a different county. Fort Lauderdale and the rest of Broward County, Miami and the rest of Miami-Dade County, Orlando and Orange County, and Tampa and Hillsborough County each use a different recorder. So do Martin County and St. Lucie County.

How it works on ClickDocs

You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.

  1. Answer the ClickDocs questions for a Florida financial durable power of attorney.
  2. Preview the draft before checkout.
  3. After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
  4. Record with the Palm Beach County Clerk of the Circuit Court & Comptroller only if you need it in Official Records. Recording is optional for validity.

The document ClickDocs prepares is the financial form. It is not a statutory form.

Florida requirements

These are statewide Chapter 709 rules. Palm Beach County does not add its own execution statute on top of them.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. Do not shorten this to "signed and notarized," and do not turn it into a Palm Beach County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.

Some authority, including gifts, must be separately signed or initialed under § 709.2202. Whether a title company wants the document recorded is an attorney question. The recording page does not name a power of attorney. It points readers to Florida Statute 28.222(3) for what kinds of instruments the office records. That pointer is not a duty to record, and it is not a statement that an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second West Palm Beach page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.

Recording in Palm Beach County

Recording is optional for validity. On 2026-10-02 the recording page, the recording FAQ, the forms page, and the fee page did not name a power of attorney. The forms list has no power-of-attorney form. A Clerk Official Records search has listed Power of Attorney as a document category. That label is not the recording instructions. It is not a duty to record, and it is not a statement that the office cannot record one. Whether a title company wants it recorded needs a Florida attorney.

The county recorder is the Clerk of the Circuit Court & Comptroller. In Palm Beach County those are one office, not a separate comptroller website and not a city hall. The Recording Department records documents into the Official Records of Palm Beach County. Every official page checked on 2026-10-02 uses that combined title. Do not use a city hall, and do not use the court e-filing portal, to record a financial power of attorney.

The homepage names Shannon Ramsey-Chessman, CPA, CGFO, as Palm Beach County Clerk Ad Interim. That is the name on that page, not a claim about who is at the counter today.

Primary recording page (checked 2026-10-02): Palm Beach County Clerk, Recording. Recording FAQ: recording FAQ. Phone and address directory: phone numbers and addresses. Main Courthouse hours and floor list: Main Courthouse facility directory. Clerk homepage: mypalmbeachclerk.com.

Where to go

In person, the main counter is the Main Courthouse Recording Department, 205 N. Dixie Highway, Room 4.2500, West Palm Beach, FL 33401. The phone directory prints the same place as 205 North Dixie Highway, 4th Floor, Room 4.2500. The facility page shortens the courthouse to 205 N. Dixie Hwy. and lists Recording at Room 4.2500. "N." and "North," "Hwy." and "Highway," and whether the line says "4th Floor" are the same building, not a second door. Room 4.2500 agrees on the recording page, the directory, and the facility list.

Phone for Recording: (561) 355-2991. Email on the recording pages: [email protected]. Do not treat email as a way to record a power of attorney.

Hours: Monday through Friday, 8 a.m. to 4 p.m., except designated holidays. The pages checked did not print a holiday calendar. This page does not invent a closed date.

Regular mail goes to the Recording Department at P.O. Box 4177 in West Palm Beach. The clerk pages agree on that box. They do not print one ZIP line. Use the mail line on the current recording page before you send anything.

Express or courier delivery goes to the Main Courthouse, 205 N. Dixie Highway, Room 4.2500, West Palm Beach, FL 33401. The recording page says to send express delivery there, or to mail to the P.O. box.

Do not mail a power of attorney for recording to the Records Service Center copies mailbox, P.O. Box 4526. That room is the same Room 4.2500, but the box is for copies and searches, not for recording. Copies and searches are a different page: Official Records copies and searches.

Make checks payable to the Clerk of the Circuit Court & Comptroller, Palm Beach County. For mail, send full payment, no cash, and a self-addressed stamped envelope. In person, the fee page lists cash, credit card, check, or money order. Those are the payment types the pages name. This page does not copy a charge.

Customers who record by mail, and customers who record at the counter, get the original back without a recording stamp. A copy or a certified copy is a separate request. The fee page says unclaimed documents will be destroyed after six months. That is not a rule about whether the power of attorney is valid.

In person, mail, and vendor e-recording

In person, at the Main Courthouse, Room 4.2500, or at a branch the recording page lists, Monday through Friday, 8 a.m. to 4 p.m., except designated holidays. The recording page has a Same Day Recording heading for in-person presentation, except designated holidays. It also says some documents are accepted only at the Main Courthouse. Power of attorney is not on that list. Not being on the list is not a promise that a branch will take one, and it is not a promise that a power of attorney is in the same-day set. For a time-sensitive document, the page recommends recording in person. Confirm the current counter before you go.

Main-courthouse-only list (power of attorney is not on it): documents accepted at the Main Courthouse only.

By mail, use the Recording Department box above after you confirm the ZIP on the current recording page. Include the Recording Transmittal Form. Send full payment, no cash, and a self-addressed stamped envelope. The page says it cannot guarantee that documents will be recorded the same day they are received. This page does not promise same-day recording for mail.

The Recording Transmittal Form is on the Clerk's forms page. That page has no power-of-attorney form. A deed, a domicile form, a notice of commencement, or a lien form from that office is not this document. forms for recording.

eRecording is through a third-party vendor, 24 hours a day, 7 days a week. The Clerk says documents must be submitted through a vendor, and the Clerk cannot recommend or endorse vendors. You cannot e-record a power of attorney on the Clerk's own site. The page says the most common eRecorded types are deeds, mortgages, assignments, and satisfactions, and that certain types cannot be eRecorded. Power of attorney is not on the cannot-eRecord list. Not being on that list is not a promise that a power of attorney can be eRecorded, and it is not a promise that every vendor will take one. The page also says same-day recording is not guaranteed. This page does not promise same-day recording for eRecording, and it does not use the notice-of-commencement timing line as the clock for this document.

Vendors as grouped on the eRecording page on 2026-10-02, not re-ordered. Volume: CSC eRecording Solutions; eRecording Partners Network; Hopdox; Indecomm Global Services; Simplifile; Swift eRecording Services. Specialty or lower volume: Deeds.com, Inc.; E-Recording Inc.; File and Go; iRecord365; QuickDeeds.com; RecordNation. Phones stay on the Clerk's page. They are not copied here.

eRecording page (checked 2026-10-02): Palm Beach County eRecording. Types the Clerk says cannot be eRecorded (power of attorney is not on the list): documents that cannot be eRecorded.

Questions about eRecording use the email on that page. That email is not a way to record a power of attorney.

No separate consumer upload portal for a financial power of attorney was on the pages checked. The eRecording cover page is a stamp-space sheet, not this product.

On Wednesdays, notices of commencement and related documents can be recorded at Palm Beach County Planning, Zoning & Building, Vista Center, 2300 N Jog Road, 1st Floor, West Palm Beach. Payment there is credit card only. That counter is not a city recorder, and it is not the counter for this document.

The recording page discusses witness addresses for deeds and easements notarized in Florida, and for other documents that convey, assign, encumber, or dispose of title to real property. It also discusses a prepared-by note under Florida Statute 695.26 for documents that affect real property. Power of attorney is not named. A Florida attorney should review those notes before anyone applies them to a financial power of attorney. They are not a substitute for § 709.2105, and they are not a Palm Beach County execution rule.

Staff cannot give legal advice. The pages also say a document originally created and executed with an electronic signature must be electronically recorded. That sentence is not a rule that a paper financial power of attorney must be e-recorded.

Recording charges

See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.

The fee page did not name a power of attorney. This page does not copy a figure from it. The recording-fee calculator is for deeds, mortgages, lis pendens, and other documents. It is not a power-of-attorney price. recording fees. Calculator (not a power-of-attorney fee): recording-fee calculator.

Not the court portal

Recording a financial power of attorney is the Clerk & Comptroller Recording path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.

The Main Courthouse lists courtrooms and court divisions on other floors. Recording is the fourth-floor Room 4.2500 service. Do not take a power of attorney to a courtroom to record it.

Boca Raton

Boca Raton uses the same Clerk of the Circuit Court & Comptroller as West Palm Beach. The recording page did not list a Boca Raton counter. Boca Raton does not have a city recorder. Recording, if you record, is still the county office.

Delray Beach

Delray Beach uses the same Clerk. The South County Courthouse is in Delray Beach, at 200 W. Atlantic Ave. It is a county branch, not a Delray Beach city recorder. The clerk pages do not settle a recording room for that branch. This page does not print one. Confirm the current counter on the recording page before you go. A branch listing is not a promise that the branch will take a power of attorney.

Boynton Beach

Boynton Beach uses the same Clerk of the Circuit Court & Comptroller. The recording page did not list a Boynton Beach counter. Boynton Beach does not have a city recorder.

Other places in Palm Beach County

Palm Beach Gardens is the North County Courthouse, at 3188 PGA Blvd. It is a county branch, not a city recorder. The clerk pages do not settle a recording room or a recording phone for that branch. This page does not print a room. Confirm the current counter on the recording page before you go.

Belle Glade uses the West County Courthouse, 2950 State Road 15, Room S-100, Belle Glade. That is still this Clerk. Do not send a power of attorney to the West County court mail box, P.O. Box 4115. That box is not the Recording Department box.

Royal Palm Beach has a branch at 200 Civic Center Way, Suite 400, Royal Palm Beach. The phone directory says no mail is accepted at that branch. Royal Palm Beach is a different municipality from the Town of Palm Beach. It is still this Clerk, not its own recorder.

The Town of Palm Beach does not have its own recorder. It uses this same Clerk.

Wellington, Jupiter, and Lake Worth Beach use this same Clerk. No separate Official Records office was published for them.

The rest of Palm Beach County uses this same Clerk.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.

It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.

This page is the financial document under Chapter 709. It does not cover health-care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.

Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The recording list does not name a power of attorney, and this page does not turn that silence into a duty to record or into a ban.
