Durable Power of Attorney in Naples (Collier County), Florida

Quick answer

A durable power of attorney in Naples is a Florida Chapter 709 financial document for money and property in Collier County. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, use the Collier County Clerk of the Circuit Court & Comptroller, Recording Department, in Naples, not a city hall and not the court portal.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in Naples or Collier County, or who may use the document with property here.

Naples is the lead city. The phrase people type, naples durable power of attorney, is this page. So is durable power of attorney naples. A collier county durable power of attorney is the same financial document. There is no second city page, and there is no separate county page.

One office records for the whole county: the Clerk of the Circuit Court & Comptroller, through the Recording Department. There is no city recorder. The counter the recording pages print is in Naples. That counter is the same Clerk.

Marco Island, Immokalee, and Everglades City use that Clerk. They are mentions on this page, not their own pages. No city recorder was published for them.

Who this is not for

This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health care documents.

It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.

It is not a lawyer page. ClickDocs does not tell you to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.

It is not the recording page for a different county. Fort Myers and the rest of Lee County use a different recorder, and so do Tampa and Hillsborough County, St. Petersburg and Pinellas County, Orlando and Orange County, Fort Lauderdale and Broward County, Miami and Miami-Dade County, and Palm Beach County.

Florida requirements

These are statewide Chapter 709 rules. Collier County does not add its own execution statute on top of them. The Clerk's notes about instruments that affect real-property title are not a second signing rule for this document.

A Florida power of attorney is not durable without the § 709.2104 words, or similar words of intent. Source: Florida Senate, § 709.2104 (2026), checked 2026-10-02.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into a Collier County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.

Except as § 709.2108 provides, the power of attorney is exercisable when executed. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.

Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Whether a title company wants the document recorded is an attorney question. The Recording Information how-to does not name a power of attorney. An Ask the Clerk paraphrase, and a search type labeled PA : Power of Attorney, are not a duty to record. They are also not a statement that an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Naples page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this city page): /learn/florida-durable-power-of-attorney.

Recording in Collier County

Recording is optional for validity. On 2026-10-02 the Recording Information how-to did not use the words "power of attorney." It names mortgages, deeds, satisfactions, assignments, leases, and documents from court cases. That list is not a finding that this document must be recorded, and it is not a finding that the Clerk will refuse one.

The recording page says recorded documents create the Official Records and that recording gives constructive notice to the public. That description is not a duty to record a financial power of attorney.

The Ask the Clerk page says the office serves as the County Recorder and may only record documents authorized by law. It paraphrases sect. 28.222, Florida Statutes. The first classification it prints includes powers of attorney relating to any instruments. That is the office's published statement of authority. It is not the statute text, and this page does not treat the paraphrase as the text of § 28.222. The paraphrase is not a duty to record every financial power of attorney, and it is not Chapter 709.

The Official Records search lists the document type PA : Power of Attorney. The page printed Last Verified Date: 10/1/2026. A search-menu type is not the Recording Information how-to, and it is not a duty to record.

The county recorder is the Clerk of the Circuit Court & Comptroller, through the Recording Department. The Ask the Clerk page says the office serves as the County Recorder. Crystal K. Kinzel is the name on the site contact block, as Clerk of the Circuit Court & Comptroller, at the same Naples street the Recording Department block prints. That is the name on the page, not a claim about who is at the counter.

There is no second recorder website, and there is no city recorder. Do not use a Naples city hall, or the court e-filing portal, to record a financial power of attorney.

Primary recording page (checked 2026-10-02): Collier Clerk, Recording Information. Ask the Clerk (paraphrase of sect. 28.222; not the statute text, and not a duty to record): Ask the Clerk. Official Records search (type PA : Power of Attorney; not a duty to record): Official Records search. Recording forms (no durable power of attorney form on the list): recording forms.

Where to go

In person, the address the recording pages print is Collier County Clerk of the Circuit Court, Recording Department, 3315 Tamiami Trail East, Suite 102, Naples, FL 34112. A 2022 notice prints the same street as 3315 Tamiami Trail E., Suite 102, Naples FL 34112. Same suite. Not a second door.

Phone: (239) 252-2646. The PO Box notice gives the same number for recording questions.

Questions can go to [email protected]. Do not treat email as a way to record a power of attorney.

The Recording Information page does not print a recording-window close. Other clerk pages print hours for the courthouse, the Annex, and satellites, and those lines are not the same. This page does not pick a close time, and it does not apply a courthouse close to a promise about when a mailed document is recorded. Confirm the current hours with the Clerk before you go.

The recording pages print one street and one suite. A satellite newsletter says recording clerks are at the Growth Management building in addition to the main recording office in the Government Center Courthouse. A later newsletter uses the words Annex building for the Recording Department, and it prints hours for the main Courthouse and Annex. This page does not pick Courthouse versus Annex. It does not invent a second Naples street from those building words.

Suite 102 is also printed on other clerk contact blocks. Court case filing is not this counter. The Value Adjustment Board form DR-486POA is a tax-appeal representation form. It is not a Chapter 709 durable power of attorney, and it is not the recording how-to.

The recording-forms list includes business-account forms, a declaration of domicile, a notice of commencement, and other clerk forms. It does not include a durable power of attorney form. The page says those forms are for reference only and are not legal advice.

In person, mail, the Clerk's e-recording account, and a partner

In person, at the main office, 3315 Tamiami Trail East, Suite 102, Naples, FL 34112. The e-recording page says time-sensitive documents should be presented in person at the main office, where they will be recorded while you wait. That line is the main office only. It is not a satellite counter, and it is not a promise about mail or an electronic submission.

By mail, use that same street address, with a prepaid self-addressed envelope for the return of the recorded documents. The PO Box was discontinued effective November 1, 2022. The notice does not print the old box number. Do not mail a financial power of attorney to a box. Notice to PO Box customers.

Public e-recording on the Clerk's own site is a real path. The e-recording page says members of the public may register for a public e-recording account, submit from a computer, tablet, or phone, and pay by card. Standard recording fees apply. The sign-in is the Clerk's e-recording sign-in, not a city portal. A separate mobile page says a phone photo can start a submission. Image rules on the e-recording page call for black and white, 300 dpi, and letter or legal size. Business customers may use an escrow account. This page does not promise that every image will be accepted.

The same page also names a partner path, and it says the Clerk makes no specific endorsements. Named on the page checked 2026-10-02: CSC e-Recording; E-Recording Partners Network (ePN); ICE / Simplifile. Being listed is not a promise that every vendor will take a financial power of attorney. Phones stay on that page. Vendor prices are not copied here.

Mail and electronic submissions, including submissions through a third-party vendor, are processed as time permits. The Clerk does not guarantee that those methods are recorded on the day they are received. Do not read the in-person "while you wait" line as a promise for mail or for an electronic submission. e-recording. Mobile submission through the Clerk account (not a second recorder): mobile e-recording.

The Ask the Clerk page also recites formalities aimed at instruments that convey, assign, encumber, or otherwise dispose of title to real property. Power of attorney is not named inside that list. A Florida attorney should review it before anyone applies that deed-style discussion to a financial power of attorney. It is not a substitute for § 709.2105, and it is not a Collier County execution rule.

Marriage licenses, passports, DMV records, court or traffic payments, and domestic-violence injunctions appear as other services. They are not this document.

Satellites

Satellite scope is not settled. A satellite page says notices of commencement and declarations of domicile can be submitted at satellite offices. It also says people walk out with originals recorded at the main courthouse or at Growth Management, and it uses the words "any other time-sensitive documents." A 2022 Heritage Bay flyer lists clerk recording there as notices of commencement and declarations of domicile, not a general instrument list. A later page says satellites offer a broad range of court and official-records services and does not name a power of attorney.

This page does not promise that a financial power of attorney can be recorded at Growth Management, at Heritage Bay, or at another satellite. It also does not say those counters cannot take one. Heritage Bay is not an Immokalee recorder. Satellite recording services.

Courthouse and Annex wording, used here only for the unresolved building line, not for a close time: recording streamlines services.

Recording charges

See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.

The fee page returned on 2026-10-02 and it prints a table. No figure, rate, or example from that table is copied here. The e-recording page says standard recording fees apply. A vendor may add its own price. This page does not copy one. recording fees.

Not the court portal

Recording a financial power of attorney is the Clerk & Comptroller Recording Department path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. A Clerk notice uses the words e-filing and e-recording together when it talks about mail volume. That sentence is not a direction to file this document as a court case. myflcourtaccess.com.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.

It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.

This page is the financial document under Chapter 709. It does not cover health care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.

Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The recording how-to does not name a power of attorney. The Ask the Clerk paraphrase and the search type do not create a duty to record, and they do not create a ban.
