Durable Power of Attorney in Fort Myers (Lee County), Florida
Quick answer
A durable power of attorney in Fort Myers is a Florida Chapter 709 financial document for money and property in Lee County. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, use the Lee County Clerk of the Circuit Court & Comptroller, Official Records Services, in Fort Myers, not a city hall and not the court portal.
Who this is for
This page is for an adult who wants a Florida financial durable power of attorney and lives in Fort Myers or Lee County, or who may use the document with property here.
Fort Myers is the lead city. The phrase people type, durable power of attorney Fort Myers, is this county page. One office records for the whole county: the Clerk of the Circuit Court & Comptroller, through Official Records Services. There is no city recorder. The counter in Fort Myers is that same Clerk.
A Lee County durable power of attorney is the same financial document. Cape Coral uses that Clerk too. Cape Coral is a section on this page, not a separate recording office.
Bonita Springs, Estero, Lehigh Acres, Sanibel, and Fort Myers Beach use that same office when the address is in Lee County. They are not separate recording offices, and this page is not a city page for any of them. Part of Lehigh Acres sits outside Lee County. This page does not promise that every Lehigh Acres address records here. If the property or the person is in another county, that county's clerk is the recorder.
Who this is not for
This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health care documents.
It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.
It is not a lawyer page. ClickDocs does not tell you to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.
It is not the recording page for a different county. Naples and the rest of Collier County use a different recorder. So do Tampa and Hillsborough County, St. Petersburg and Pinellas County, Orlando and Orange County, Fort Lauderdale and Broward County, Miami and Miami-Dade County, and Palm Beach County.
How it works on ClickDocs
You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.
- Answer the ClickDocs questions for a Florida financial durable power of attorney.
- Preview the draft before checkout.
- After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
- Record with the Lee County Clerk of the Circuit Court & Comptroller only if you need it in Official Records. Recording is optional for validity.
The document ClickDocs prepares is the financial form. It is not a statutory form.
Florida requirements
These are statewide Chapter 709 rules. Lee County does not add its own execution statute on top of them. The Clerk's notes about deeds are not a second signing rule for this document.

Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into a Lee County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.
Except as § 709.2108 provides, the power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.
Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Whether a title company wants the document recorded is an attorney question. The Record a Document how-to does not name a power of attorney. An eRecording type code, and a calculator menu label, are not a duty to record. They are also not a statement that an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Fort Myers page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.
Recording in Lee County
Recording is optional for validity. On 2026-10-02 the Record a Document how-to did not use the words "power of attorney." It is written around deeds and other instruments presented for recording. The Official Records Services examples list names liens, plats, certificates of title, mortgages, lis pendens, marriage licenses, deeds, judgments, death certificates, military discharges, and more. Power of attorney is not in that list. "And more" is not a finding that this document must be recorded, and it is not a finding that the Clerk cannot record one.
An eRecording type-code list, effective May 17, 2024, includes the code POA with the description Power of Attorney. A search snapshot of the fee calculator listed POWER OF ATTORNEY among document types. The calculator was not opened, and no total was copied. A type code and a menu label are not a duty to record. They are not a power-of-attorney price. They are not a promise that every vendor will accept a consumer power of attorney. Whether a title company wants the document recorded needs a Florida attorney.
The county recorder is Official Records Services, inside the Clerk of the Circuit Court & Comptroller. Clerk and Comptroller are one office here. The department page says that, as the County Recorder, Official Records Services assists with land records and other recorded instruments. Kevin C. Karnes is the name on the leadership page, as Clerk of the Circuit Court & Comptroller, elected in 2022. That page lists County Recorder among his roles. That is the name on the page, not a claim about who is at the counter today.
There is no second recorder website, and there is no city recorder. Do not use a Fort Myers city hall, a Cape Coral city hall, or the court e-filing portal to record a financial power of attorney. Collier County is not this office.
Primary recording page (checked 2026-10-02): Lee Clerk, Record a Document. Official Records Services: Official Records Services. Fort Myers facility page: Fort Myers facility. Clerk identity, as printed: About our leadership. Official Records FAQ: Official Records FAQ. eRecording type codes (effective May 17, 2024; not a duty to record): eRecording type codes.
Where to go
In person, the Fort Myers counter is the County Administration Building, 2115 Second Street, 2nd Floor, Fort Myers, FL 33901. The Record a Document page prints the same street without the floor: Fort Myers Location, 2115 Second Street. The street line and the 2nd-floor line are the same building, not a second door. The clerk pages do not print a second Fort Myers recording entrance.
Official Records phone on that facility page: (239) 533-5007. The building header also prints a call-center number, (239) 533-5000. Both numbers are on the live facility pages. The clerk pages print both, and they do not say one replaced the other.
eRecording vendor contact: [email protected]. Do not treat email as a way to record a power of attorney.
The clerk pages do not settle the recording-counter hours. They print a call-center hours line, a lobby hours line, and, on the Cape Coral branch, an hours-of-operation line. Those lines do not match. The call-center close is not the lobby close, and a lobby close is not a promise about when a document is recorded. Confirm the current hours with the Clerk before you go. The facility pages say hours exclude observed holidays. The holiday list stays on those pages.
A different address on Second Street is not this counter. 2201 Second Street is not the Official Records recording room. The Justice Center at 2075 Dr. Martin Luther King Jr. Boulevard, Fort Myers, FL 33901, is where the facility page places court divisions. It is not the recording counter. Do not take a financial power of attorney there to record it.
The unclaimed-money service is not this document. A notarized power of attorney on that page is a claim form for a check reissue. It is not a Chapter 709 recording, and that counter is not Official Records intake.
In person, mail, drop box, and vendor e-recording
In person, at 2115 Second Street, 2nd Floor, Fort Myers, FL 33901. Cape Coral is also listed for in-person recording, at 1039 SE 9th Place. The clerk pages do not settle whether that counter records a power of attorney the same way Fort Myers does. They also do not settle a recording-counter close. See the Cape Coral section. For a time-sensitive document, the eRecording page says to record in person. Confirm the current counter before you go.
By mail, use Lee County Clerk of Courts, Recording Department, P.O. Box 2278, Fort Myers, FL 33902. The Record a Document page prints the same box: Lee County Clerk of Courts, PO Box 2278, Fort Myers, FL 33902. Include a self-addressed stamped envelope. Make the check or money order payable to Lee County Clerk of Courts. Use only that box. Do not use the general or administration mailbox printed in the site footer, and do not use any other box.
If you do not include a self-addressed stamped envelope, the Record a Document page says recorded documents are held until one is provided. Documents still held after 90 days will be destroyed. The clerk page does not give a shorter hold.
A drop box is a drop-off, not the place the document is recorded. The Record a Document page says to put the document, payment, and a self-addressed stamped envelope in a sealed envelope and drop it outside the Fort Myers office at 2115 Second Street, or in Cape Coral at the Lee County Government Center at 1039 SE 9th Place. The 90-day line applies if no return envelope is provided.
eRecording is through a third-party vendor, not a Clerk upload page. The eRecording page says submission to Official Records Services is online through a vendor, and that the Clerk's office cannot recommend or endorse vendors. You cannot e-record a power of attorney on the Clerk's own site. No separate consumer upload portal for a financial power of attorney was on the pages checked. The page does not guarantee when a submitted document is recorded. It says a time-sensitive document should be recorded in person.
Higher-volume submitters, as printed on 2026-10-02: CSC eRecording Solutions; eRecording Partners Network; Hopdox; Indecomm; Simplifile. Lower-volume submitters, as printed: E-Recording USA; File and Go; Record-Nation. The page says those indirect services are typically focused on specific document types, such as a Notice of Commencement and lien or claim-related documents, and that the Clerk has no direct relationship with those providers. The POA type code is not a promise that every vendor will take a financial power of attorney. Phones stay on the Clerk's eRecording page. They are not copied here. eRecord Official Records.
The Record a Document page says the Clerk cannot assist with completing forms. The Official Records FAQ says the Clerk's office is restricted by state law from offering legal advice and does not provide forms. A large part of the how-to recites deed requirements and points at Chapter 695.26, Florida Statutes, including witness names and addresses, a notary acknowledgment, and blank space at the top of pages. Power of attorney is not named in that requirements text. A Florida attorney should review it before anyone applies that deed discussion to a financial power of attorney. It is not a substitute for § 709.2105, and it is not a Lee County execution rule.
Marriage licenses, passports, notary service at the counter, and court case filing are other services of this office. They are not this document.
Recording charges
See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.
The fee page to use is Fees & Costs. On 2026-10-02 a search index of that page showed the category Official Records, Recording, and Land Records. The fee table itself is not copied on this page, and this page does not copy a figure from a snippet, a calculator, or an older table. The calculator is not a power-of-attorney price. The Official Records FAQ says recording fees are listed under the Fee Schedule. Fees & Costs. Calculator (not a power-of-attorney fee; no total copied): fee calculator.
Not the court portal
Recording a financial power of attorney is the Clerk & Comptroller Official Records path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.
The Justice Center on Dr. Martin Luther King Jr. Boulevard is not the recording counter. Do not take a financial power of attorney there to record it.
Cape Coral
Cape Coral uses the same Clerk of the Circuit Court & Comptroller as Fort Myers. It is not a city recorder, and it is not a city hall. It is not Collier County.
The branch address, as printed, is 1039 SE 9th Place, 2nd Floor, Cape Coral, FL 33990. The Record a Document page prints the street as Cape Coral Location: 1039 SE 9th Place. The street line and the 2nd-floor line are the same branch, not a second building.
The Cape Coral branch header also prints the call-center number (239) 533-5000. The Official Records block prints (239) 533-5007. Both belong on this page.
The branch page lists Recording Official Records, and it lists marriage licenses and ceremonies. It says passport services are not available in Cape Coral. A search index of a published Recording Deeds document prints the Cape Coral address with the words "limited services." That file is not the live how-to, and this page does not quote it for charges. The clerk pages do not settle full service versus limited services. They do not say the Cape Coral counter will refuse a power of attorney, and they do not say it is the same counter as Fort Myers. Confirm the current branch rules with the Clerk before you rely on that counter.
The clerk pages do not use one building name. The drop-box line says Lee County Government Center at 1039 SE 9th Place. The Official Records block says Lee Government Center at that same street, 2nd floor. The branch header prints the street, floor, and ZIP and does not print a building name. Those wordings are not a second Cape Coral building. No extra complex name is added here.
The hours for this branch are not settled, for the same reason as Fort Myers. The pages do not print one recording-counter close. Confirm before you go. Lee Clerk, Record a Document. Cape Coral facility page: Cape Coral facility. The published Recording Deeds file, used here only for the unresolved "limited services" line, not as the how-to and not for any fee table: Recording Deeds (published file).
Bonita Springs, Estero, Sanibel, and Fort Myers Beach use this same Clerk. No Official Records office was published for them. Lehigh Acres uses this Clerk only when the address is in Lee County. Part of Lehigh Acres is in another county. Not every Lehigh Acres address is in Lee County.
What the document can and cannot do
It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.
It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.
This page is the financial document under Chapter 709. It does not cover health care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.
Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The recording how-to does not name a power of attorney. The type code and the calculator label do not create a duty to record, and they do not create a ban.

It is not for a health care surrogate or a living will. It is not for Naples or the rest of Collier County, and it is not for a different Florida county.
Why is Cape Coral on a Fort Myers page?
Fort Myers is the lead city. One Clerk of the Circuit Court & Comptroller records for the whole county. Cape Coral is a branch of that same Clerk, at 1039 SE 9th Place, not a city recorder. Bonita Springs, Estero, Lehigh Acres, Sanibel, and Fort Myers Beach are mentions on this page when the address is in Lee County. They do not have a city recorder. Part of Lehigh Acres is outside Lee County.
Do I have to record a financial durable power of attorney in Lee County?
Recording is optional for validity. The Record a Document how-to does not name a power of attorney. An eRecording type code for POA, and a calculator menu label, are not a duty to record, and they are not a statement that an unrecorded power of attorney is invalid. The pages also do not say the Clerk cannot record one. Whether a title company wants it recorded needs a Florida attorney. The statewide product page and the Learn page go deeper on the financial document.
Where do I record in Lee County?
Clerk of the Circuit Court & Comptroller, Official Records Services. That is one office, not a city hall. In person, the Fort Myers counter is 2115 Second Street, 2nd Floor, Fort Myers, FL 33901. Official Records phone (239) 533-5007. Call center (239) 533-5000. Both are on the facility pages. The facility pages do not agree on a recording-counter close, so no close time is printed here. Confirm hours with the Clerk. Cape Coral is the same Clerk at 1039 SE 9th Place, 2nd Floor, Cape Coral, FL 33990. Whether that branch is full service or limited services is unresolved. Do not use the Florida Courts E-Filing Portal. Do not use the Justice Center on Dr. Martin Luther King Jr. Boulevard.

In person, at 2115 Second Street, 2nd Floor, in Fort Myers. Cape Coral is also listed, at 1039 SE 9th Place. The clerk pages do not say that branch is the same counter as Fort Myers. By mail, use Lee County Clerk of Courts, Recording Department, P.O. Box 2278, Fort Myers, FL 33902, with a check or money order payable to Lee County Clerk of Courts, and a self-addressed stamped envelope. Do not use any other box. If no return envelope is provided, documents still held after 90 days will be destroyed. A drop box outside the Fort Myers office, or at the Cape Coral branch, is a drop-off. It is not the place the document is recorded. Online, only through a third-party eRecording vendor. You cannot upload one on the Clerk site itself. The POA type code is not a promise that every vendor will take one. The eRecording page does not guarantee when a document is recorded. A time-sensitive document should be recorded in person.
What is unresolved about Cape Coral and the hours?
The Cape Coral branch page lists Recording Official Records. A search index of a Recording Deeds document prints that address as limited services. The clerk pages do not settle that conflict. The drop-box line says Lee County Government Center, and the Official Records block says Lee Government Center, at the same street. That is not a second building. Call-center hours, lobby hours, and the Cape Coral hours-of-operation line are not the same close. No close time is chosen here. Phones (239) 533-5007 and (239) 533-5000 are both printed on the facility pages. Confirm the counter, the branch, and the hours with the Clerk.
Can I use the court e-filing portal or the Justice Center to record it?
No. The Florida Courts E-Filing Portal is for court documents. The Justice Center on Dr. Martin Luther King Jr. Boulevard is not the recording counter. If you record a financial power of attorney, you use the Clerk of the Circuit Court & Comptroller, Official Records Services.
How do I get the document on ClickDocs?
Answer the questions, preview the draft, then sign with two witnesses and a notary. ClickDocs does not notarize it on this page. The start page is the Florida financial durable power of attorney only.
What are the Florida signing rules?
Your signature, two subscribing witnesses, and a notary acknowledgment, under § 709.2105. It is not durable without the § 709.2104 words, or similar words. Lee County does not add its own execution rule. The Chapter 695.26 notes from the Clerk are about deeds and instruments presented for recording in that discussion. They do not name a power of attorney. Ask a Florida attorney before you apply those notes to this document. They are not a substitute for the signing statute.
Can I make it start only if I become incapacitated?
Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.
Is this a health care document?
This page is the financial document under Chapter 709. It does not cover health care documents. A durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The health care document is a separate designation, not this form.
Which places does this page cover?
Fort Myers and the rest of Lee County, through one Clerk. Cape Coral is a required branch section, not its own page. Bonita Springs, Estero, Sanibel, and Fort Myers Beach are mentions. Lehigh Acres is a mention only when the address is in Lee County. A different county, including Collier County, has a different recorder.
Is this a statutory form?
No. ClickDocs does not call this financial document a statutory form.
ClickDocs is not a law firm. Using this page or the form does not create an attorney-client relationship. This page describes a Florida financial durable power of attorney under Chapter 709 and Lee County Clerk of the Circuit Court & Comptroller facts checked on 2026-10-02. It is not legal advice. It does not tell you to sign. Talk to a Florida attorney about homestead, gifts, capacity, whether a title company wants the document recorded, and before you apply the Clerk's deed-presentation notes to a financial power of attorney. Confirm the counter, the hours, the Cape Coral branch rules, the mail box, and the recording charges with the Clerk before you go. Charges can change. The facility pages do not settle a recording-counter close, and they do not settle whether Cape Coral recording is full service or limited services. No recording price is stated on this page.
