Durable Power of Attorney in Brevard County, Florida
Quick answer
A durable power of attorney in Brevard County is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, use the Brevard County Clerk of the Circuit Court and Comptroller, not a city hall and not the court portal.
Who this is for
This page is for an adult who wants a Florida financial durable power of attorney and lives in Brevard County, or who may use the document with property here.
The phrase people type, brevard county durable power of attorney, is this page. So is durable power of attorney brevard county. A brevard county durable power of attorney is the same financial document. The page is the county. There is no city in the title, and there is no second city page.
One office records for the whole county: the Brevard County Clerk of the Circuit Court and Comptroller. The site also prints "Clerk of Court and Comptroller." There is no city recorder. Melbourne is not the title of this page.
Titusville and Viera are sections because the Clerk's plat page names those two places for plat and survey recording appointments. Melbourne and Palm Bay are sections as clerk branches, not as recording counters. None of those four is its own page.
Merritt Island has a clerk office on the contact page, the Merritt Island Service Complex, 2575 North Courtenay Parkway, Room 129, Merritt Island, FL 32953. The contact page gives it the same split hours as Palm Bay. It is not labeled a recording counter. It is not a section on this page.
Cocoa, Rockledge, Cape Canaveral, Satellite Beach, West Melbourne, and Suntree are not sections. No recording counter in those places was published on the pages checked. The rest of Brevard County uses this same Clerk. No separate municipal recorder was published.
The site footer lists six offices. That list is on the whole site. It is not six recording counters.
Who this is not for
This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health care documents.
It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.
It is not a lawyer page. ClickDocs does not tell you to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.
Orange County, Seminole County, Indian River County, and Volusia County each use a different clerk.
How it works on ClickDocs
You can finish a Florida financial DPOA without a law-firm maze. The signing rules and any recording choice stay yours.
- Answer the ClickDocs questions for a Florida financial durable power of attorney.
- Preview the draft before checkout.
- After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
- Record with the Brevard County Clerk of the Circuit Court and Comptroller only if you need it in Official Records. Recording is optional for validity.
The document ClickDocs prepares is the financial form. It is not a statutory form.
Florida requirements
These are statewide Chapter 709 rules. Brevard County does not add its own execution statute on top of them. The pages checked do not publish a separate witness list for powers of attorney. This page does not add one.
A Florida power of attorney is not durable without the § 709.2104 words, or similar words of intent. Source: Florida Senate, § 709.2104 (2026), checked 2026-10-03.
Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into a Brevard County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-03.
Except as § 709.2108 provides, the power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-03.
Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Whether a title company wants the document recorded is an attorney question. The Official Records page does not name a power of attorney. That silence is not a duty to record, and it is not a refusal. It does not mean an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Brevard County page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.
Recording in Brevard County
Recording is optional for validity. On 2026-10-03 the Official Records page did not use the words "power of attorney." It says the Clerk is the recorder of all instruments required or authorized to be recorded in one general series of Official Records books, upon payment of the statutory fees. It says the documents are in most cases related to real estate. The example list is deeds, mortgages, liens, contracts, affidavits, subdivision plats, surveys, declarations of condominium, bills of sale, judgments, certificates of military discharge, and declarations of domicile. Power of attorney is not in that list. That list is not a finding that this document must be recorded, and it is not a finding that the Clerk will refuse one.
The article does not name a city counter. A search description on that page is not a duty to record. The page does not print a search code for a power of attorney.
Rachel Miller Sadoff is the name on the Meet the Clerk page, as Clerk of the Circuit Court and Comptroller. That is the name on the page, not a claim about who is at the counter.
There is no second recorder website, and there is no city recorder. Do not use a city hall to record a financial power of attorney.
Primary recording page (checked 2026-10-03): Brevard Clerk, Official Records recording.
The recording contact on the office directory, and the question line on the eRecording page, is phone (321) 637-2006 and [email protected]. The directory also lists fax (321) 264-5246 on that heading. That email is the published Recording contact. It is not a way to send a power of attorney in for recording.
Official Records research is a different line: (321) 637-2004. The Official Records article also gives that number for a copy of a federal tax lien as filed. It is not the recording intake line.
The main line on the contact page is (321) 637-5413.
Office directory (checked 2026-10-03): Office directory. Meet the Clerk (checked 2026-10-03): Meet the Clerk.
Two notices on the Official Records page are about a written request to add injunction information to a public website, and a notarized request to remove certain exempt information or certain images. Those notices are not a power of attorney rule. "One of our branch offices" in those notices is about those requests. It is not a list of recording counters.
The pages checked do not print a sentence that says to bring a power of attorney to a named counter. Plat maps and surveys are the documents the live pages tie to named recording appointments. Those appointments are Monday through Friday, 8:00 AM to 4:00 PM, at the Parkway Office in Titusville and the Moore Justice Center in Viera. That 4:00 PM line is the appointment window for plat maps and surveys. It is not the close of every counter.
Contact locations (checked 2026-10-03): Contact. Plat and survey recording appointments (checked 2026-10-03): Plat map and survey appointments.
The recording-forms page does not offer a durable power of attorney form. A declaration of domicile on that page is a residency statement. A quitclaim deed is not this product. The sentence on that page about recording and a public index is about the forms that page offers. It is not a duty to record this document. Recording forms.
Titusville
Titusville is a section because the plat page offers plat and survey recording appointments at the Parkway Office, and the recording email uses Parkway. It is the same Clerk, not a city recorder, and not its own page.
Parkway Office, as the plat page prints it: 700 S. Park Avenue (Bldg. B), Titusville, FL 32780. Appointments there are for plat maps and surveys, Monday through Friday, 8:00 AM to 4:00 PM. That appointment line is not a rule that every financial power of attorney is taken at that door.
Mail is not that door. Recording Department mail, as the contact page prints it: P.O. Box 2767, Titusville, FL 32781-2767. The same box is also printed under Copy Requests. It is one box, not two offices, and it is not a walk-in counter. The Parkway street ZIP and the box ZIP are not two recorders. The box stays on the mail line. The street stays on the Parkway line.
Overnight delivery for all departments, as the contact page prints it: Clerk of Court, 700 S Park Avenue, Bldg B, Titusville, FL 32780-4015. That ZIP+4 is the same Parkway building as 32780. It is not a second office.
Court paperwork uses a different Titusville box. Do not mail a recording to the court-paperwork box.
The contact page also lists "Administration, Human Resources, & Full-service counter (Titusville Office)" at 400 South Street, Titusville, FL 32780, Monday through Friday, 8:00 AM to 5:00 PM, excluding holidays. The site footer prints 400 South St., Titusville, FL 32780, and does not print a floor. The official pages do not agree on the floor, and this page does not pick a floor and does not print a floor number. They are not two buildings on that street. The contact page does not say what full-service includes. This page does not say that counter records a financial power of attorney, and it does not say the counter cannot take one.
The contact page lists other Titusville doors that are not labeled recording. This page does not send a financial power of attorney to those doors.
Viera
Viera is a section because the plat page offers plat and survey recording appointments at the Moore Justice Center. It is the same Clerk, not a city recorder, and not its own page. A plat appointment is not a rule that every financial power of attorney is taken at that door.
The plat page prints 2825 Judge Fran Jamieson Way, Viera, FL 32940. Appointments there are for plat maps and surveys, Monday through Friday, 8:00 AM to 4:00 PM. That 4:00 PM line is not the close of the building.
The contact page prints Moore Justice Center / Viera Courthouse, 2825 Judge Fran Jamieson Way, Viera 32940. It does not print FL on that line. Hours on that block are Monday through Friday, 8:00 AM to 5:00 PM, excluding holidays.
The official pages do not agree on whether that line includes FL, and this page does not pick. The site footer shortens the street word. This page does not print that shortening. The lines are not a second building.
Melbourne
Melbourne is a clerk branch on this page. It is not a recording counter, not a city recorder, and not its own page. The plat page does not list Melbourne. The office directory does not give this branch its own recording phone.
Melbourne Branch Courthouse, 51 Nieman Avenue, Melbourne, FL 32901. The contact page lists Monday through Friday, 8:00 AM to 5:00 PM, excluding holidays. The footer prints 51 Nieman Ave., Melbourne, FL 32901, 8:00 AM to 5:00 PM.
Those hours are the branch hours on the contact page. They are not a recording-counter promise, and they are not the 4:00 PM plat-appointment window.
Palm Bay
Palm Bay is a clerk office on this page. It is not a recording counter, not a city recorder, and not its own page. The plat page does not list Palm Bay. The office directory lists the Palm Bay branch phone as the main line, (321) 637-5413. That is not the recording intake line.
Palm Bay Office, 450 Cogan Drive SE, Palm Bay, FL 32909.
The contact page and the site footer do not agree on Palm Bay hours, and this page does not pick one day. This page does not print those hours. It does not treat the disagreement as a recording-counter promise.
In person, mail, and a third-party vendor
In person, the pages checked do not name a counter for a financial power of attorney. Plat and survey recording appointments are the named in-person recording appointments, at the Parkway Office and the Moore Justice Center, Monday through Friday, 8:00 AM to 4:00 PM. The full-service label at 400 South Street stays as printed above. This page does not promise the Melbourne Branch Courthouse, the Palm Bay Office, or the Merritt Island office as a recording counter.
By mail, use the Recording Department box: P.O. Box 2767, Titusville, FL 32781-2767. Overnight for all departments is the Parkway street with ZIP 32780-4015, the same building as the Parkway appointment address. The pages checked do not say whether a counter hands the original back or returns it by mail. They do not spell out a return-envelope rule.
e-Recording is through a third-party vendor. The eRecording page says it is a way to submit documents for recordation in the Official Records. It says documents may be submitted 24 hours a day, 7 days a week. It says eRecording expedites the speed at which documents are recorded. "24 hours a day" is when a person may submit through a vendor. It is not a clock for when the Clerk finishes recording. The page does not describe a public account on the Clerk's own site.
Vendors named on that page: CSC eRecording Systems; eRecording Partners Network; HopDox; Simplifile. The page says the Clerk's office cannot recommend a specific vendor. Phones and vendor prices stay on that page. They are not copied here. Being listed is not a promise that a vendor will take a financial power of attorney.
Examples on that page include deeds, mortgages, satisfactions, and notices of commencement. The unavailable list is Lien/Judgment to Bond, Foreign Judgment, Notice of Homestead, Notice of Contest of Lien, and Plat/Condo/Road Plat Maps. Power of attorney is not on the example list, and it is not on the unavailable list. This page does not add it to either list. eRecording.
Marriage licenses, passports, jury, traffic, tax deed sales, foreclosure sales, and court filing appear as other services. They are not this document.
Recording charges
See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.
The fee page links a Schedule of Fees Reference Chart. The chart has a Recording heading. No figure from that chart is copied here. A recording fee calculator on the Clerk site carries a 2018 file date. That date is not a current fee. This page does not copy a total from it. A vendor may add its own price. This page does not copy one. Fees and charges. Schedule of Fees Reference Chart: Schedule of Fees Reference Chart.
Not the court portal
Recording a financial power of attorney is the Clerk recording path above. The Clerk's site lists E-Filing and eRecording as separate online services. Court e-filing is for court filings. It is not this step. E-Filing.
The Florida Courts E-Filing Portal is for filing court documents online. The court portal is myflcourtaccess.com. It is not the way to record this document. myflcourtaccess.com.
What the document can and cannot do
It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.
It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.
This page is the financial document under Chapter 709. It does not cover health care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-03.
Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The Official Records page does not name a power of attorney. That does not create a duty to record, and it does not create a refusal.

Your signature, two subscribing witnesses, and a notary acknowledgment, under § 709.2105. It is not durable without the § 709.2104 words, or similar words. Brevard County does not add its own execution rule. The pages checked do not publish a separate witness list for a power of attorney.
Can I make it start only if I become incapacitated?

Talk to a Florida attorney about homestead, gifts, capacity, and whether a title company wants the document recorded. Confirm the counter, the floor, the hours, and the mail address with the Clerk before you go. The official pages do not agree on the Titusville floor, on whether the Viera line includes FL, or on Palm Bay hours, so this page does not pick. Charges can change.
