Durable Power of Attorney in Polk County, Florida
Quick answer
A durable power of attorney in Polk County is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, use the Polk County Clerk of the Circuit Court and Comptroller, not a city hall and not the court portal.
Who this is for
This page is for an adult who wants a Florida financial durable power of attorney and lives in Polk County, or who may use the document with property here.
The phrase people type, polk county durable power of attorney, is this page. So is durable power of attorney polk county. A polk county durable power of attorney is the same financial document. The page is the county. There is no city in the title, and there is no second city page. Lakeland is not the title of this page.
One Clerk records for the whole county: the Polk County Clerk of the Circuit Court and Comptroller. The About the Clerk page also names the role of County Recorder. There is no city recorder.
Bartow, Lakeland, and the Northeast Government Center are sections because the Official Records page says official records can be recorded at those three offices. None of the three is its own page.
The contact page also lists a Comptroller office at 330 W. Church St., Bartow. That office is not in the three-office recording sentence. It is not a section on this page.
Haines City is not a section. It appears only on the Northeast Government Center mail line. Winter Haven, Auburndale, Davenport, Lake Wales, Frostproof, Mulberry, and Eagle Lake are not sections. No recording counter in those places was published on the pages checked. The rest of Polk County uses this same Clerk. No separate municipal recorder was published.
The contact page lists four facilities. That list is not four recording counters. The recording sentence names three.
Who this is not for
This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health care documents.
It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.
It is not a lawyer page. ClickDocs does not tell you to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.
Hillsborough County, Osceola County, Orange County, and Lake County each use a different clerk.
How it works on ClickDocs
You can finish a Florida financial DPOA without a law-firm maze. The signing rules and any recording choice stay yours.
- Answer the ClickDocs questions for a Florida financial durable power of attorney.
- Preview the draft before checkout.
- After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
- Record with the Polk County Clerk of the Circuit Court and Comptroller only if you need it in Official Records. Recording is optional for validity.
The document ClickDocs prepares is the financial form. It is not a statutory form.
Florida requirements
These are statewide Chapter 709 rules. Polk County does not add its own execution statute on top of them. The pages checked do not publish a separate witness list for powers of attorney. This page does not add one.
A Florida power of attorney is not durable without the § 709.2104 words, or similar words of intent. Source: Florida Senate, § 709.2104 (2026), checked 2026-10-03.
Execution is the principal's signature, two subscribing witnesses, and an acknowledgment before a notary, or as § 709.2105 provides. That section also points to § 695.03 for the acknowledgment. Do not shorten this to "signed and notarized," and do not turn it into a Polk County rule. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-03.
Except as § 709.2108 provides, the power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-03.
Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Source: Florida Senate, § 709.2202 (2026), checked 2026-10-03.
Whether a title company wants the document recorded is an attorney question. The Official Records page does not name a power of attorney. That silence is not a duty to record, and it is not a refusal. It does not mean an unrecorded power of attorney is invalid. The statewide product page and the Learn page go deeper on the financial document. They are not a second Polk County page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.
Recording in Polk County
Recording is optional for validity. On 2026-10-03 the Official Records page did not use the words "power of attorney." It says that as County Recorder, the Clerk maintains the official records of the county. It says there are more than 350 types of records. The example list is final court judgments, property records such as deeds, mortgages, notices of commencement, liens, and plats, HOA documents when required to be recorded, and marriage licenses. Power of attorney is not in that list. "When required to be recorded" in that sentence is about HOA documents. It is not a finding that this document must be recorded, and it is not a finding that the Clerk will refuse one.
The page does not print a search code for a power of attorney.
Stacy M. Butterfield, CPA, is the name on the About the Clerk page, as Clerk of the Circuit Court and Comptroller, including the County Recorder role. That is the name on the page, not a claim about who is at the counter.
There is no second recorder website, and there is no city recorder. Do not use a city hall to record a financial power of attorney.
Primary recording page (checked 2026-10-03): Polk Clerk, Official Records.
The pages checked do not print a separate Official Records phone. The contact page and the site footer print 863-534-4000. A second number, 863-733-8045, is the Traffic and Court Payment Center. Do not send a recording question to that line.
Contact page (checked 2026-10-03): Contact. About the Clerk (checked 2026-10-03): About the Clerk. Hours (checked 2026-10-03): Hours and Holidays.
The hours page says Monday through Friday, 8 a.m. to 4:30 p.m. It does not name Bartow, Lakeland, Lake Alfred, or Haines City, and it does not print a time zone. The same page says the Clerk's office is closed on the days in its Holiday Schedule 2026 list. This page does not split those hours by office, and it does not turn them into a promise that each counter takes a power of attorney at every minute of that window.
Two notices on the Official Records page are about a request to remove certain Chapter 119 information or certain images from a public website, and a request to add information when a final injunction for protection of a minor is entered. Those notices are not a power of attorney rule. Both say fax copies cannot be accepted. That line is about those requests. It is not a rule that the Clerk refuses a recorded document by fax, and it does not name a power of attorney.
The contact page has a heading for emailing the Clerk's office and does not print an address under that heading. The removal notice links "by email" to [email protected]. The addition notice prints [email protected]. Those notices are about Chapter 119 website requests. The official pages print two domains, and this page does not pick one. Neither address is a way to email a power of attorney in for recording. [email protected] is the records-custodian line, not a recording inbox.
The forms page does not offer a durable power of attorney form. A declaration of domicile on that page is a residency statement. A quiet-title complaint is not this product. A tax-deed form is not this product. Forms and Packets.
The contact page lists a Comptroller office at 330 W. Church St., Bartow, FL 33830-3912. Mail for that office is PO Box 988, Bartow, FL 33830-3912. That office is not in the three-office recording sentence. This page does not send a financial power of attorney to that door or that box.
Bartow
Bartow is a section because the Official Records page names it as one of the three offices where official records can be recorded. It is the same Clerk, not a city recorder, and not its own page.
In person, as the contact page prints it: Polk County Courthouse, 255 N. Broadway Ave., Bartow, FL 33830-3912. The two Chapter 119 notices on the Official Records page print the same street as 255 N. Broadway Ave., Bartow, Florida 33830, and do not print the +4. The official pages do not agree on the +4, and this page does not pick. They are not two courthouses.
Mail for Official Records and Tax Deeds is not that street by itself. The contact page and both Official Records notices print PO Box 9000, Drawer CC-8, Bartow, FL 33831-9000. Include the drawer. The box and the courthouse street are not two recorders. The box stays on the mail line. The street stays on the courthouse line.
Physical deliveries and certified mail for the courthouse use 255 N. Broadway Ave., Bartow, FL 33830-3912.
Do not mail a recording to Drawer CC-18. That drawer is Records and Evidence, and the records-custodian address, not Official Records and Tax Deeds. Do not mail a recording to PO Box 988. That box is the Comptroller office, not this courthouse line.
Lakeland
Lakeland is a section because the Official Records page names it as one of the three offices where official records can be recorded. It is the same Clerk, not a city recorder, and not its own page. Lakeland is not the title of this page.
In person, as the contact page prints it: Lakeland Government Center, 930 E. Parker St., Lakeland, FL 33801-1929. That in-person line does not print a room.
The mail table prints the same street and ZIP, 930 E. Parker St., Lakeland, FL 33801-1929, and adds Room 240. Room 240 stays on the mail line. It is not added to the in-person line.
Northeast Government Center
The Northeast Government Center is a section because the Official Records page names it as one of the three offices where official records can be recorded, and that sentence places it in Lake Alfred. It is the same Clerk, not a city recorder, and not its own page. Haines City is not its own section.
In person, as the contact page prints it: Northeast Government Center, 200 Government Center Blvd., Lake Alfred, FL 33850. That matches the recording sentence, which says the third office is in Lake Alfred.
The mail table prints the same facility name at 200 Government Center Blvd., Haines City, FL 33844. The street number matches. The city and the ZIP do not. The official pages do not agree, and this page does not pick a city or a ZIP. They are not a second building.
In person, mail, and a third-party partner
In person, the Official Records page says official records can be recorded at any of the three offices: Bartow, Lakeland, or the Northeast Government Center in Lake Alfred. The pages checked do not print a sentence that says to bring a power of attorney to a named counter. The Comptroller office at 330 W. Church St. is not one of those three.
By mail, Official Records and Tax Deeds go to PO Box 9000, Drawer CC-8, Bartow, FL 33831-9000. Lakeland mail adds Room 240 at 930 E. Parker St. Northeast mail prints 200 Government Center Blvd., Haines City, FL 33844, while the in-person line prints Lake Alfred, FL 33850. The pages checked do not say whether a counter hands the original back or returns it by mail. They do not spell out a return-envelope rule. Do not send cash.
e-Recording is through a third-party partner. The eRecording page says it lets customers file and record documents online with the Official Records Department. It says the customers who should use it are attorneys, closing agents, title companies, and contractors. It says those customers scan the original, convert it to an electronic image, add indexing information, and submit it to the Clerk's office. It says to contact a partner to get an office started. The page does not describe a public account on the Clerk's own site.
The same page says those customers no longer need to submit records by express mail, courier, or in person. That sentence is about the eRecording audience. It is not a statement that the three offices have stopped taking documents. The Official Records page still says official records can be recorded at those three offices.
The eRecording page says documents are typically recorded the same day, and that an image with the recording stamp can be retrieved once the document is recorded. "Typically" is the page's word for eRecording in general. It is not a promise that a financial power of attorney is recorded the same day. For eRecording, the page says original documents never leave the customer's possession. That sentence is about eRecording. It is not a counter return method.
Partners named in the directory: CSC, eRecording Partners Network, File and Go, Hopdox, Indecomm, QuickDeeds.com, and SimpliFile. Phones and partner prices stay on that directory. They are not copied here. Two labels, "Notice of Commencement" and "Deeds," appear in the listing without a sentence that ties them to a partner. This page does not assign those labels. Being listed is not a promise that a partner will take a financial power of attorney.
Under documents that cannot be eRecorded, the page names DD-214, Notice of Contest of Lien, Notice of Homestead, Power of Attorney – Bail Bonds, and a warranty deed that includes a lien on real property filed as one document. A Chapter 709 financial power of attorney is not the bail-bond line. That line is not a ban on this document. Power of attorney is otherwise absent from the page. That silence is not a promise that this document can be eRecorded. eRecording. Partner directory (checked 2026-10-03): eRecording partners.
Marriage licenses, passports, jury, traffic, tax deeds, court filing, evictions, and foreclosures appear as other services. They are not this document.
Recording charges
See the fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.
The fee page has a Recording Fees heading and an Official Records block. No figure from that page is copied here. A vendor may add its own price. This page does not copy one. The traffic and court blocks on that page are not this product. Fees.
Not the court portal
Recording a financial power of attorney is the Clerk recording path above. The Clerk's site has a separate E-Filing page. That page is about court filings in circuit and county civil, circuit and county criminal, criminal and civil traffic, family, juvenile, and probate. It is not this step. The Official Records page does not send recording to that portal. E-Filing.
The court portal is myflcourtaccess.com. It is not the way to record this document. myflcourtaccess.com.
What the document can and cannot do
It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.
It is not durable without the § 709.2104 words. A clause that waits for a future date or a future event does not make a delayed product, except as § 709.2108 provides.
This page is the financial document under Chapter 709. It does not cover health care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-03.
Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The Official Records page does not name a power of attorney. That does not create a duty to record, and it does not create a refusal. The eRecording cannot-list names Power of Attorney – Bail Bonds only. That line is not this document.

An adult who wants a Florida financial durable power of attorney and lives in Polk County, or who may use the document with property here. It is not for a health care surrogate or a living will. It is not for a different Florida county.
Why is this a county page, not a city page?
The recorder is one Polk County Clerk of the Circuit Court and Comptroller for the whole county. There is no city in the title. Bartow, Lakeland, and the Northeast Government Center are sections because the Official Records page says official records can be recorded at those three offices. They are not their own pages, and they are not city recorders. Lakeland is not the title of this page. Haines City is not a section. The Comptroller office at 330 W. Church St. is not in that recording sentence.
Do I have to record a financial durable power of attorney in Polk County?
Recording is optional for validity. The Official Records page does not name a power of attorney. That is not a duty to record, and it is not a refusal. It is not a statement that an unrecorded power of attorney is invalid. The pages also do not say the Clerk will refuse one. The eRecording page names Power of Attorney – Bail Bonds on a cannot-eRecord list. A Chapter 709 financial power of attorney is not that line. Whether a title company wants it recorded needs a Florida attorney. The statewide product page and the Learn page go deeper on the financial document.
Where do I record in Polk County?
Polk County Clerk of the Circuit Court and Comptroller. That is one Clerk, not a city hall. The phone on the contact page and the footer is 863-534-4000. Official records can be recorded at the Polk County Courthouse in Bartow, the Lakeland Government Center, or the Northeast Government Center. Hours on the hours page are Monday through Friday, 8 a.m. to 4:30 p.m. That line is not split by office. Mail for Official Records and Tax Deeds is PO Box 9000, Drawer CC-8, Bartow, FL 33831-9000. Can I record in person, by mail, or through a partner?
Official records can be recorded at the three offices named on the Official Records page: Bartow, Lakeland, and the Northeast Government Center in Lake Alfred. The pages do not print a walk-in script for a power of attorney. Mail for Official Records and Tax Deeds is PO Box 9000, Drawer CC-8, Bartow, FL 33831-9000. Lakeland mail adds Room 240. Northeast mail prints Haines City, FL 33844, and the in-person line prints Lake Alfred, FL 33850. The pages do not say how the original comes back, and they do not spell out a return envelope. Do not send cash. e-Recording is third-party partners only: CSC, eRecording Partners Network, File and Go, Hopdox, Indecomm, QuickDeeds.com, and SimpliFile. There is no public account on the Clerk site. Being listed is not a promise that a partner will take a financial power of attorney. The page says documents are typically recorded the same day. That is not a promise for this document. The Official Records page still says official records can be recorded at those three offices. [email protected] and [email protected] are on Chapter 119 notices. Neither is a way to email this document in for recording.
Why do the Bartow lines look different?
The contact page prints 255 N. Broadway Ave., Bartow, FL 33830-3912. The Official Records notices print 255 N. Broadway Ave., Bartow, Florida 33830, with no +4. The official pages do not agree on the +4, and this page does not pick. They are not two courthouses. Mail is PO Box 9000, Drawer CC-8, Bartow, FL 33831-9000. The box and the street are not two recorders. Do not mail a recording to Drawer CC-18 or to PO Box 988. Confirm the counter with the Clerk before you go.
Why does Lakeland print a room on one line only?
The in-person table prints Lakeland Government Center, 930 E. Parker St., Lakeland, FL 33801-1929, and no room. The mail table adds Room 240 at that street. Room 240 stays on the mail line. It is not added to the in-person line.
Why do the Northeast lines name two cities?
The Official Records sentence and the in-person table say Northeast Government Center, 200 Government Center Blvd., Lake Alfred, FL 33850. The mail table says 200 Government Center Blvd., Haines City, FL 33844. The street number matches. The city and the ZIP do not. The official pages do not agree, and this page does not pick. They are not a second building. Haines City is not its own recording office on this page.
Can I use the court e-filing portal to record it?
No. The Florida Courts E-Filing Portal is for court documents. Court e-filing on the Clerk site is a separate page from Official Records. If you record a financial power of attorney, you use the Polk County Clerk of the Circuit Court and Comptroller.
How do I get the document on ClickDocs?
Answer the questions, preview the draft, then sign with two witnesses and a notary. ClickDocs does not notarize it on this page. The start page is the Florida financial durable power of attorney only.
What are the Florida signing rules?
Your signature, two subscribing witnesses, and a notary acknowledgment, under § 709.2105. It is not durable without the § 709.2104 words, or similar words. Polk County does not add its own execution rule. The pages checked do not publish a separate witness list for a power of attorney.
Can I make it start only if I become incapacitated?
Except as § 709.2108 provides, a power of attorney is exercisable when executed. It is ineffective if it says it becomes effective at a future date or on a future event or contingency, except as that section provides. ClickDocs does not offer a springing power of attorney.
Is this a health care document?
This page is the financial document under Chapter 709. It does not cover health care documents. A durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority.
Is a clerk residency form this document?
No. A declaration of domicile is a residency statement. It is not this financial document. A quiet-title complaint, a tax-deed form, a marriage license, a passport, and a court packet are not this document either.
Which places does this page cover?
Polk County, through one Clerk. Bartow, Lakeland, and the Northeast Government Center are sections, not their own pages. Haines City is not a section. Winter Haven, Auburndale, Davenport, Lake Wales, Frostproof, Mulberry, and Eagle Lake are not sections. The Comptroller office at 330 W. Church St. is not a recording section. A different county has a different recorder.
Is this a statutory form?
No. ClickDocs does not call this financial document a statutory form.
ClickDocs is not a law firm. Using this page or the form does not create an attorney-client relationship. This page describes a Florida financial durable power of attorney under Chapter 709 and Polk County Clerk facts checked on 2026-10-03. It is not legal advice. It does not tell you to sign. Talk to a Florida attorney about homestead, gifts, capacity, and whether a title company wants the document recorded. Confirm the counter, the city, the ZIP, the room, the hours, and the mail address with the Clerk before you go. The official pages do not agree on the Northeast city and ZIP, on whether the Bartow street includes the +4, or on Room 240, so this page does not pick. Charges can change. No recording price is stated on this page. The pages checked do not say how the original comes back from the counter.
