Durable Power of Attorney in Fort Lauderdale (Broward County), Florida

Quick answer

A durable power of attorney in Fort Lauderdale is a Florida Chapter 709 financial document for money and property. It is not durable without the § 709.2104 words, or similar words. It needs your signature, two witnesses, and a notary. Recording is optional for validity. If you record it, you use Broward Records, Taxes and Treasury, not the court e-filing portal.

Who this is for

This page is for an adult who wants a Florida financial durable power of attorney and lives in Fort Lauderdale or Broward County, or who may use the document with property here.

Fort Lauderdale is the lead city. The recording office is in Fort Lauderdale and serves the whole county. Hollywood, Pembroke Pines, and Miramar use that same County Recorder.

Who this is not for

This page is not for someone looking for a health care surrogate or a living will. This page is the financial document under Chapter 709. It does not cover health-care documents.

It is not for someone who wants the power of attorney to wait until a doctor says they lack capacity. A new springing clause is generally ineffective under § 709.2108. ClickDocs does not offer a springing power of attorney.

It is not a lawyer page. ClickDocs does not tell you whether to sign, whether you have capacity, or how homestead or gifts should be handled. Those questions need a Florida attorney.

It is not the recording page for a different county. Miami and the rest of Miami-Dade, Boca Raton, Delray Beach, West Palm Beach, and the rest of Palm Beach County, Tampa and Hillsborough, and Orlando and Orange each use a different recorder.

How it works on ClickDocs

You can finish a Florida financial durable power of attorney here without a law-firm maze. The signing rules and any recording choice stay yours.

  1. Answer the ClickDocs questions for a Florida financial durable power of attorney.
  2. Preview the draft before checkout.
  3. After you have the document, it still needs your signature, two witnesses, and a notary acknowledgment under § 709.2105. ClickDocs does not notarize it on this page.
  4. Record with Broward Records, Taxes and Treasury only if you need it in Official Records. Recording is optional for validity.

The document ClickDocs prepares is the financial form. It is not a statutory form.

Florida requirements

These are statewide Chapter 709 rules. Broward does not add its own execution statute on top of them.

Execution is your signature, two subscribing witnesses, and an acknowledgment before a notary. That is § 709.2105. Source: Florida Senate, § 709.2105 (2026), checked 2026-10-02.

The power of attorney is effective when executed. A new clause that waits for a future event is generally ineffective under § 709.2108. That is not a product on this page. Source: Florida Senate, § 709.2108 (2026), checked 2026-10-02.

Some authority, including gifts, must be separately signed or initialed under § 709.2202. This page does not claim the form grants those powers unless the form itself has that separate signature or initial. Homestead, gifts, and capacity need a Florida attorney. Source: Florida Senate, § 709.2202 (2026), checked 2026-10-02.

Whether a title company wants the document recorded is an attorney question. The statewide product page and the Learn page go deeper on the financial document. They are not a second Fort Lauderdale page. Statewide product: /florida/durable-power-of-attorney. Learn (planned article, not this county page): /learn/florida-durable-power-of-attorney.

Recording in Broward County

Recording is optional for validity. The County Records page lists documents such as deeds, mortgages, notices, liens, and similar instruments, and it says “and etc.” It does not name a power of attorney. That silence is not a duty to record, and it is not a statement that the office cannot record one. Whether a title company wants it recorded needs a Florida attorney.

Records, Taxes and Treasury is the statutory repository for the Official Records of the county. On the recording page the role name is County Recorder. That office records and indexes documents authorized, entitled, or required by law to be recorded, and it collects statutory fees. It says it is not authorized to give legal advice, and it is not authorized to determine the legal rights of the parties.

The Clerk of Courts is a different office. Do not use that counter, and do not use the court e-filing portal, to record a financial power of attorney.

Primary recording page (checked 2026-10-02): Broward County Records. Division home (who the office is, and the Recording Office hours): Records, Taxes and Treasury. Search of records already in Official Records is not the recording counter: Official Records public search.

Where to go

The recording office is in the Broward County Governmental Center in Fort Lauderdale. It serves the whole county.

The county’s own pages do not agree on one mailing address. This page does not pick one. Use the current County Records page for the address before you go or send anything.

Phone on the recording office: 954-831-4000 or 3-1-1. The fee page uses the same call center number, 954-831-4000.

Hours, as printed for the Recording Office on the division home: Monday through Friday, 8:30 a.m. to 5 p.m. That block does not add a holiday sentence. A Notice of Commencement block on the Information page says regular hours are Monday to Friday, 8:30 a.m. to 5 p.m., excluding Broward County holidays. This page does not invent a different closing time.

The email on the division home is not a way to record a power of attorney.

In person, mail, and vendor e-recording

In person: at the County Recorder in Fort Lauderdale. Confirm the current address on the County Records page before you go.

Mail: the published mail path calls for the recording fees and any documentary stamp tax that is actually due, plus a self-addressed stamped envelope. The general “you may mail your document” sentence does not print a mailing address. Confirm the current mail address with the recorder. Do not guess.

eRecord only through a third-party vendor. Documents must be submitted through a third-party vendor. Some direct eRecording vendors may not offer single-use submission. Broward County cannot recommend or endorse a vendor. Power of attorney is not named on that eRecording text. This page does not claim you can e-record a financial power of attorney.

Direct submitters listed on the Information page, alphabetical as printed on 2026-10-02: CSC eRecording; E-Docs Solutions; eRecording Partners Network (ePN); Hopdox; ICE Mortgage Technology (formerly Simplifile); ICE Mortgage Technology (Consumer Edition); Indecomm (formerly US Recordings); Swift-E Recording Services. A separate government-agency web service is not a consumer path.

eRecording instructions (checked 2026-10-02): Broward electronic recording.

No drop box was published on the County Records page or the division home checked 2026-10-02. Do not use one.

No Broward cover sheet was on the County Records page, the fee page, or that eRecording text. Do not add one from another county.

The County Records page quotes a witness-name rule for an instrument that conveys, assigns, encumbers, or otherwise disposes of an interest in real property. A Florida attorney should review that quote before anyone applies it to a financial power of attorney. It is not a substitute for § 709.2105.

Recording charges

See the County Recorder fee page. Charges can change. These are general recording charges, not a power-of-attorney fee.

That fee page is Records, Taxes and Treasury, not the court Clerk of Courts fee list. Do not use a copy charge or a calculator total as a power of attorney price. County Recorder fee page.

Not the court portal

Recording a financial power of attorney is the County Recorder path above. The Florida Courts E-Filing Portal is for filing court documents online. Do not use myflcourtaccess.com to record a durable power of attorney. myflcourtaccess.com.

The Clerk of the Circuit and County Courts is a different office: Brenda D. Forman, at 201 SE 6th Street, Fort Lauderdale, FL 33301, phone (954) 831-6565. That is the court site, not the Official Records counter. The court site’s records-request page sends official recorded documents, mortgages, and deeds to broward.org and to (954) 831-4000. Broward Clerk of Courts. Clerk records request.

A different power of attorney on the county forms page

The county forms list includes a power of attorney for the Broward County tourist development tax. That is a different document. It is not this financial durable power of attorney, and it is not the form on this page.

Hollywood, Pembroke Pines, and Miramar

Hollywood, Pembroke Pines, and Miramar are Broward cities. They use the same County Recorder as Fort Lauderdale. They do not have a city recorder.

Also in Broward, same office: Coral Springs, Pompano Beach, Plantation, Sunrise, Davie, Deerfield Beach, and Weston.

Other Broward cities and unincorporated Broward use this same office.

What the document can and cannot do

It can name an agent for financial matters under Chapter 709 when it has the durability words and Florida execution: signature, two witnesses, and a notary.

It is not durable without the § 709.2104 words. A new springing clause does not make a delayed product under § 709.2108.

This page is the financial document under Chapter 709. It does not cover health-care documents. Section 709.2201 says a durable power of attorney may include health care decisions only if that authority is specifically granted. This ClickDocs form does not add that authority. The form stays financial. The health-care document is a separate Chapter 765 designation, not this form. Source: Florida Senate, § 709.2201 (2026), checked 2026-10-02.

Recording is optional for validity. Skipping it does not, by itself, make the document invalid. Whether a title company wants it in Official Records needs a Florida attorney. The County Records page does not name a power of attorney, and this page does not turn that into a recording rule.
