Guardianship vs a Florida power of attorney: court when the paper never got signed
A durable power of attorney is something you sign while you can still decide. Guardianship is a Florida court process that can appoint someone to act when that window has already closed. They are not interchangeable. One starts with your signature under Chapter 709. The other starts with a petition under Chapter 744.
Facts, not legal advice. ClickDocs prepares a Florida financial durable power of attorney. It does not file guardianship cases and does not create an attorney-client relationship.
Who this is for
You are comparing guardianship and a power of attorney for a Florida parent, spouse, or yourself.
You want the plain split: private document while capacity exists, versus court when it does not.
You are trying to avoid a court file if a durable power of attorney can still be signed correctly.
Who this is not for
Someone who only needs a health care decision-maker. That is usually a Chapter 765 designation of health care surrogate. See /learn/florida-health-care-surrogate.
Someone who already has a contested guardianship hearing on the calendar. That needs a Florida attorney, not document prep.
Someone hunting for a DIY guardianship petition kit. ClickDocs does not sell one.
The Florida power of attorney side
A Florida financial durable power of attorney names an agent for money and property under Chapter 709.
It is not durable without the § 709.2104 words, or similar words.
A Florida-executed power of attorney needs the principal’s signature, two witnesses, and a notary acknowledgment under § 709.2105.
Authority is generally exercisable when executed under § 709.2108. New “wait until a doctor says so” clauses are usually ineffective. ClickDocs does not sell a springing product.
If the adult who would be the principal already lacks capacity, a new power of attorney is usually not available. Families then look at court tools. That call belongs to a Florida attorney, not a form shop.

The Florida guardianship side
Guardianship is a court process under Florida Statutes Chapter 744. A court can appoint a guardian to exercise legal rights for a person the court finds incapacitated (or for certain minors and other protective arrangements the chapter covers).
This page does not walk you through filing a petition, emergency temporary guardianship, or guardian education hours. Those are court and attorney topics.
The practical contrast people feel:
| Florida durable POA | Florida guardianship | |
|---|---|---|
| Who starts it | The principal, while able to sign | A petitioner in court |
| Court file | Usually none for the document itself | Yes |
| Ends at death | Yes, under § 709.2109(1)(a) | Court process has its own end rules |
| ClickDocs product | Yes, financial DPOA prep ($89) | No |
What happens to a power of attorney when guardianship starts
Florida Statutes § 709.2109 ties the two worlds together.
A power of attorney can terminate when the principal is adjudicated totally or partially incapacitated, unless the court keeps some agent powers alive.
If someone files to determine incapacity or to appoint a guardian advocate, agent authority under the power of attorney is generally suspended until the petition is dismissed or withdrawn, or the court authorizes the agent again. There is a family-member exception that still requires a verified motion under § 744.3203 before suspension in some cases. Read the statute. Do not guess from this paragraph in a real case.

Supported decisionmaking is not a substitute durable POA
Florida Statutes § 709.2209 describes a supported decisionmaking agreement. It lets an agent receive information and help with communication. It does not grant authority to bind the principal. It is not a durable power of attorney under § 709.2104. Durability language in that agreement has no effect.

When ClickDocs still fits
If the adult who needs help can still understand and sign, a Florida financial durable power of attorney may be the private-document path. ClickDocs prep is $89. You answer questions, preview before you pay, then finish with two witnesses and a notary you arrange. Partner remote online notarization is planned separately and is not sold on this page.

When you need a Florida attorney instead
Talk to a Florida attorney when:
- Capacity to sign is already in doubt
- A guardianship petition is filed or about to be filed
- You need advice on whether a limited guardianship, guardian advocacy, or another Chapter 744 tool fits
- Banks, hospitals, or family members are fighting over who may act
- Homestead, gifts, trusts, or Medicaid planning sit on top of the incapacity question
