Can a Florida power of attorney agent make medical decisions?
A Florida financial power of attorney does not automatically let the agent make medical decisions. Here is what Florida Chapter 709 says for document prep. This is not legal advice.
Florida Statutes § 709.2201(1) limits an agent to authority the document specifically grants. A line that says "do everything I can do" grants nothing. Health care is different again: § 709.2201(2)(c) allows health care decisions in a durable power of attorney only when that authority is specifically granted.
Most Florida hospitals and clinics look for a Chapter 765 designation of health care surrogate. That is the usual medical document. ClickDocs keeps its Florida durable power of attorney financial-only and points medical questions to /learn/florida-health-care-surrogate.
If a health care advance directive and a power of attorney conflict, § 709.2109(3)(b) says the directive controls unless the power of attorney is later and expressly states otherwise. That conflict call belongs to a Florida attorney, not a checkout form.
